Solicitors Regulation Authority investigate a law firm working for Morton House 20:09 - Aug 20 with 5198 viewsDaleEamonn

Greetings Rochdale fans.

Following my release on Sunday of the Alexander Jarvis email of 20th July 2021 which set out his real intentions alongside an attached presentation from your club's AGM, the Solicitors Regulation Authority is now investigating a law firm involved in supporting the affairs of Morton House Mgt and First Form Construction Limited regarding the sources of funds received by that law firm and the checks which that law firm made prior to accepting receipt of those funds.

An Investigation Officer has been appointed by the Solicitors Regulation Authority and the role of that Investigation Officer is to decide what further action is required. The Solicitors Regulation Authority is liaising with the law firm concerned who are providing full co-operation and disclosure.

It may assure you to know that the Solicitors Regulation Authority is already aware of many issues regarding the involvement of financial broker Alexander Jarvis and those others involved in the hostile takeover attempt involving your football club.

The EFL are also aware that the Solicitors Regulation Authority have launched an investigation.

I would have thought Law firms should know exactly where their clients’ money originates to check for any money laundering. Asking questions about client wealth before approving any transaction should be a given.

from looking at the SRA website, they "aim to complete 93% of investigations within 12 months"... that's an even longer, twitchier time.

as RAFC mentioned last night, if they start digging into multiple mortgages with the likes of Santander (home) & Barclays (dagenham) on top of everything else then its a big ball of wool to unravel to get to the truth. ESPECIALLY if there is a HMRC investigation running concurrently. & any other agencies who may be investigating too will just add to the complexity.

makes you wonder if this is the get out of jail free card for kilpatrick and the americans, as I'm sure they wouldn't want to be associated with an SRA investigation... this would be a good time for them to renege on their agreement to sell, you would think.

& we have, of course, offered to help the SRA in any way we can with the fan led investigations (some of which have been shared on here ).

If the solicitors are being investigated, would they, if they are upstanding and honest members of the profession want to have the stain of being investigated or being associated with potential questionable activities. Having said that, they could be the ideal people for Curran and Rose!

I hope the EFL and HMRC know about this investigation as well.

Curran and Rose must be starting to regret their association with Bottomley and Jarvis, especially if they having something to hide.

Our expectation (maybe in hope more than anything else) is that this could bring the end of this saga one step closer.

- Due to the SRA investigation, the EFL refuse the Curran / Rose / Morton House application pending the outcome (that could take 12m+). There would be nothing to stop them reapplying in future.

- This refusal gives the sellers (Kilpatrick, Marcella, Altman) the legal reason needed to back out of the deal, cancel the power of attorney and get their shares back.

- This frees up the football club to do the share issue they wanted to, raising money for the club and also increasing the % of shares held by actual fans. There could also be work done to finalise the Trust's purchase of Kelly's shares and hopefully buy the shares of the original sellers (excluding DB & GR ideally)

as we said, more in hope than anything else, but the more people that mention this course of action to the EFL the more they may consider it 🤞🏻

Jarvis and Bottomley are the ones who has dropped Curran and Rose and their business dealings well and truly in the public domain via various indiscretions.

Go back two months and absolutely no-one had ever heard of these guys. After two months of Jarvis everyone knows everything there is to know.

If you look at the known timelines from information that various supporters have dug up:

13th April - Bottomley and Curran are both known to have been in the executive facilities for the Swindon Town Tuesday night game alongside many other possible investors. There are photos from the fans protest that show Curran's Rolls Royce there.

Between 4th June and 20th July - a confidential presentation last saved by Bottomley on the 4th June somehow gets to Alexander Jarvis who sends it out to those Jarvis would like to try to agree to buy shares from.

6th July - Jarvis persuades a "recluse" to come to the club for a meeting in his Rolls Royce Cullinan in his shorts and his flip flops before the EFL have even been approached. The recluse also has a meeting with Dale Trust

I'm not surprised Jarvis is triggering various investigations into Curran and Rose left right and centre when he is saying "Furthermore, we have paid in excess of £1 million to date in consideration for shares, due diligence and legal costs."

£1m is a lot of money to have paid for a minority stake in the club when no-one can find anything out about you and the only way you speak is via Jarvis

If Jarvis is in the "we" from his MEN quote then he is stating that he involved in Morton House - which of course we all know that he isn't based on the public records.

If Jarvis IS involved with Morton House then his "we" is just like Andy Curran - why would you not be listed as a director?

This could presumably delay things further, as they maybe can’t run applications through a process that is under review. Either way, I see this as good news.

Well, we haven't heard that they have quit so I guess "no news is good news", certainly from our perspective. Maybe Curran and co, not so much.
