The FA’s compliance unit often use this method where only the accused party and the panel are present, and as has been said above, standard practise for this kind of complaint. No appeal route other than CAS In Lausanne is available to either party depending on the findings of the hearing as either Boro or Saints won’t be happy with the outcome. It is also quite possible that any ancillary evidence Boro have been busy gathering such as supposed spying on other clubs plus the ex-Saints employee who is supposed to have come forward to help Boro will not be taken into consideration as they will only look at the single complaint of the alleged spying on the Thursday before the first leg play off game and nothing else. One other interesting fact - if as you have suggested Boro really don’t have a case then THEY can be sanctioned for submitting a vexatious complaint!! I don’t think that will happen but it would be hilarious if it did - bedwetter Gibson would hurl his toys so far out of his pram you would need a search party to find them… [Post edited 14 May 22:31]

Without seeing the charge sheet; as it is the club who have been charged not the person allegedly spying it would traditionally see the club secretary summoned to appear before the panel. However, clubs are structured in different ways these days so most likely it will be the CEO who is summoned to appear. Bit of a worry as PP is not a 'football person' with 30 yrs experience but much more of a corporate animal than a traditional football one. In summary, traditionally the buck always used to stop with the Club Sec so in these changed times I'd say the CEO is a good shout. [Post edited 14 May 23:36]

You are welcome. Agreed, it is all very unsettling and it is horrible seeing our name dragged through the mud when the likes of Chelsea & Man City have done far worse. Gibson is out of control and in panic mode as the very expensive specialist sports lawyer he has hired (known as Mr.Lioohole - because he will always find one) now won’t get the opportunity to tie the hearing in knots as Boro won’t be there so Gibson is now trying to influence the outcome of the hearing through the media. Boro should definitely be hit with two improper conduct charges, one for the club and one for Gibson in person.
