Plenty of contracts will include non-compete clauses that you can't simply walk away from, and in the case of players clubs hold onto their registration so even if they terminate their contract they effectively can't work anywhere else. "Bordering on slavery" is right, and a lot of football employment stuff wouldn't stand up if firmly challenged in court (like Bosman did), but it's not in the best interests of players/agents/clubs to rock the boat too much. Players get paid as much as they do in part because their registrations/right to work are an asset clubs can buy and sell. If football employment worked like the regular world then transfer fees wouldn't exist and players would get paid far less. [Post edited 25 Jun 2023 16:28]

It will come out in arbitration hopefully. It goes on all the time but usually the buying club pays up. Martin declined to get on the plane because his people were "in the balance of probability" already talking to SFC. He was under contract to Swansea city. There is the issue of a circa £2000 air ticket. Martin declined to travel and the request may have come later. The arbitrator can take a view on this. Presumably he/ she does not require hard evidence. Perhaps there is an unanswered message or text on Winters company phone He was already on his way. He was only sacked three days ago but allegedly not seen for weeks in his office. |  |

It’s really not a very difficult concept to get your head around. When a business trip abroad is planned travel arrangements are made. They are not made a day or 2 before the actual trip, they are often in a diary weeks or even months ahead. A trip was planned. Between the planning & travel circumstances changed. It is no more likely that RM was tapped up without an approach through the club than Michael Duff was tapped up by the Swans. The club knew about Southampton’s interest in RM as Southampton have almost certainly followed all protocols to remain within League rules & guidelines. Life is complicated travel arrangement are often made late as windows of free time open up. As I understand it the "formal" request by Southampton was after June 28 th when their season had finished. Southampton had made "informal" representations to Martin or the club before the 20 th such that Martin cancelled his trip to USA. Mr Silverstein was not reportedly not happy. Martin had seemingly decided he was going to SFC so must have known the T&C s. Press reports stated Martin withdrew from the USA trip. In my opinion if the approach had not been formalised Martin should have travelled. Southampton need to pay Swansea the full amount in the contract. They were a Premier league team when they approached Martin. |  |
