The suggested ‘new law’ is a nonsense as it is already the way it works at present.
Every person convicted of murder receives a life sentence and it set a minimum term before the parole board can consider parole. Before they do that they have to be sure that there is no longer any need to detain the person for the protection of the public. They are then released on life license which means that they can be recalled for minor infractions at any time, or they are deemed to be a risk to the public, eg if they turn up drunk at probation or test positive for cannabis.
At present, we also have ‘whole life orders’ chiefly for child murderers, killers of police, sex murderers. This means they’ll never be released. Manchester bomber, Killer of Lee Rigby, Dale Cregan eg.
We have also have categories, as thing stand where the starting point is 30 years, 25 years eg, where a murder is pre planned, say they went armed with a knife.
The Tory plan has many exceptions, it only relates to Child killers, only killers over the age of 21, only victims under 16 and only if the murder is premeditated.
The ultimate decision still rests with the Judge who will have the discretion.
Looking at statistics, the number of cases that will actually be affected by this “new law” will be close to zero.
It’s a meaningless policy announcement as the sentences are widely used at present. It’ll make no difference whatsoever, that’s before I start of the closure or many local courts both in the Magistrates and Crown Court.
