They've probably been able to do this (or think they're able to do this) because it will say in his contract words to the effect that he's not to do anything that renders him unable to train and play football, barring injuries sustained in the course of that naturally. He's done something that puts him out for 18 months, basically retiring him, whereas the other two are still fit and able to play.
As said above though, firstly I would think saying you can stay on reduced money and then when he refuses it suddenly deciding its gross misconduct won't look good at a tribunal. And secondly it's pretty transparent why the two who are young and could one day be sold for money are kept on and the crusty old cripple gets bombed out.
Morally bankrupt that club over the last few years. Trying every little twist and trick to work their way around rules. |

Well yes, he was out on the lash but he was not driving the car so not sure how they could put the blame on him.
He should be suing Tom Lawrence, I doubt the driver's insurance will payout.

I agree that it would be a gross misconduct related dismissal. He will be able to sue whichever was driving for negligence (the driver likely will be uninsured, the insurer will pull cover). A bit of contributory negligence from Keoth. Nice bit of litigation! |
Surely there must be constructive dismissal in this case too? No consistency shown across the three people involved in the case? Difficult to charge one with gross misconduct and not the other two - especially taking into consideration he was a passenger rather than a drunk driver. Also the other two were arrested - more of an act of gross misconduct than being a passenger....?

I think there is a constructive dismissal limit of approximately £100k. So that could be about a months wages for someone in his position.

We also don't know the full details on what he did that night, he was club captain and supposed to set an example so he's not a completely innocent party.

The guy played 315 times for them. An incredible servant. Sacked for not accepting a pay cut on his current contract rather than as a result of his actions in the circumstances around the car crash. Sounds like he has a fairly cast iron case for constructive dismissal. I am not even sure if it is legal to sack someone on a contract for not accepting another one while the one he is under is still valid?
He did a bad thing. He has paid the price with his injury, the captaincy and I am sure a hefty fine. But to sack him for not accepting a replacement contract seems ethically wrong and certainly morally wrong.
I could have understood with his contract until 2020 that the club would come to an agreement to pay him up but to sack him seems disgusting. Not many players have remained as loyal as he has to his club.
But then again, as Clive said, Derby has been a morally corrupt club for years. Owners are scum bags and act like scum bags (allegedly) I know I have to add that. |  |

The lawyers are going to get rich off this. Gross misconduct is a sackable offence in any workplace but Derby seem to have put themselves in a tricky situation by offering him a contract on reduced terms. I presume they wouldn't have sacked him if he had agreed to the reduction. It seems to me it only became gross misconduct after he refused to sign the contract in which case they are on very shaky ground.
Derby's statement clearly says "the club will not tolerate any of its players or staff behaving in a manner which puts themselves, their colleagues, and members of the general public at risk of injury or worse, or which brings the club into disrepute," so this applies to all three players regardless of the outcome (2 can still play 1 injured and out for a long time). I've got not sympathy for him as he was clearly stupid to get into a car with a driver he must of known was over the limit but from a legal standpoint he must have a case against the club. |  | | |

Unfortunately you have to take the emotion out of this. Also the situation with the two other 'employees' is irrelevant. This is simply a matter of employment law and by his actions Keogh is unable to fulfil his contractual obligations (i.e. play) and his injury was not caused by an industrial accident i.e. playing or training.
It seems that Derby (because of his service record?) offered him a settlement - the reduced terms offer and he chose not to accept it, so they proceeded with the disciplinary action.

i read elsewhere they were going to extend it by a year, neither side comes out of it well and I think Keogh is going to need serious help from the PFA, can see him have big problems in the next few years dealing with how his career has ended, we all laugh at the Zamora goal etc but blimey he's been through some tough times the last few years and you have to worry about his mental state after all these massive lows.
We don't know what happened on the night in question or what goes on behind the scenes though, a lot more to it imo than what has come out, they won't have done this lightly |
