The lad who posted that is one of the good guys they have tbf but it seems the situation might be making him react in a way he wouldn’t usually. Give him the benefit of the doubt on that one as I assume it was him who deleted it not long after. He’s a top bloke usually.

Wholly understandable from Mederco.
Having been caught in the middle of Stewart Day’s significant property web of debt and lies their underlying investors are, quite rightly, wanting to claim from where the money ended up as an unsecured loan - bury fc.
It's also a huge spanner in the works for Steve Dale because effectively what started as his plan to deal with £3.4m of unsecured creditors sharing £875k at 25p in the £ now becomes £10.4m of unsecured creditors sharing £875k at 8.5p in the £.
Everyone else gets less and becomes less likely to support the CVA.
HMRC refusing to budge on their £1m as well does not bode well. If they and Mederco both refuse to budge then Steve Dale can't get this CVA away to achieve what he wants.
At that point, if you believe the memorandum then liquidation follows.
In that circumstance, the ground gets sold by the Official Receiver and the order of charges goes:
Capital Bridge - £3.6m
Football creditors - £0.9m
Unsecured creditors - the rest at a pence in the £ settlement
Steve Dale - any excess cash after paying off all the debts.
Steve Dale may, after all, just make a loss on his £1 investment here!

This is only an idea I had re the apparent debt without any grounds whatsoever but I am sure those here with more knowledge will be able to say if it’s legal and or possible.
SD 1 realised that his building companies are going to the wall, at whatever stage in the bURY ride, loans a load of cash to bURY in order to secure them a future short term and effectively shuts up shop at merdeco flogging it to SD 2 for a nominal figure.
He by now knows merdeco is going to die and the 8 million loan, or whatever capital he had has gone to bURY, which effectively immediately becomes SD2’s.
So effectively a soon to be insolvent set of companies transfers everything in the form of a loan to another company to be sold for a quid. New owner has done nothing wrong as far as I can see.
So in order to broker this loan an apparent 40% consultants fee was paid, around 1.4 million or so to ensure the loan was agreed, that could have gone to anyone, one of the new SD 2 trophies companies ltd or whatever accepts liability for the loan, they have no assets as such so it’s a dead duck.
SD2 does everything he can to liquidate, has maybe even been a part of the broker of the loan, and walks away losing a quid. Bury pay sod all in the pound or get liquidated, either way SD2 does not care as in truth all he has put in is a quid.
This is merely supposition so who really knows, kept that as short as I could as could have mentioned many other things!!! |  |
