Morfa shopping parking fine 19:01 - Apr 11 with 4201 viewsblaenaugwentjack

Evening all I have just received a fixed parking fine of £70.00 or £40.00 if I pay within 14 days. I foolishly arrived late at the stadium for the Birmingham City game and hastily parked in the Morfa car park from 14.40 to 17.38, Group Nexus have now sent me the file. Is this legal? Can I contest this? Or is it just pay up? Thanks in advance for any advice.

Whether they can legally enforce the fine, I’m unsure, but one thing I do know is if you don’t pay, it will effect your credit score. If I was you, I’d pay.

It is just an invoice but I do believe they are enforceable in a civil court.

I’m pretty sure they’re enforceable, they can take you to court. Not worth taking the risk

Well i am not a lawyer but a friend of mine refused to pay a similar fine.

The shops usually pay a 3rd party for parking enforcement.

It’s not my area so I may well be wrong but I’d have thought it’s basic contract law. a person has agreed to abide by their terms and conditions by parking there, and have breached the terms.
Not done contract since 97 so I maybe well out.

My wife parked there a few months ago when the Swans were playing. She was there for nearly two hours ( cannot remember exactly ) but got the fine.
I spoke to the guy who manages the retail park as wife was quite upset about the ticket. He was really reasonable and got the ticket cancelled. She did leave the shopping park at something like 4:15 though.

I had one from there about 7yrs ago and basically ignored it, the letters kept coming, increasing the fine, with the tone getting more and more threatening, then after about 2yrs they just stopped. HOWEVER I believe the law has changed in the last few years and basically you've not got a leg to stand on. You could speak to one of the managers of one of the stores, they have the power to overturn the fine, but for £40, I'd just suck it up. Good luck.

It makes me wonder why they have the carrot and stick. Pay up straight away and you get a discount. Surely, if it's a so called fine they want ppl to pay up without making a fuss, or they don't want the hassle of going to court.

If it was me, I would tell them to shove it, but i'm retired, on a private pension, I don't use credit and everything is in joint names, so there's not much they can do

If I go to B&Q by the stadium, I could be 3 hours in there, perhaps getting a quote for a kitchen, looking about the store, looking at the garden centre area.
Yet they give you 90 minutes on a match day.
That doesn't add up.
I have never paid parking fines, they go away eventually.they write letters until the cows come home. I always ignore ignore ignore. The stop in the end.
But that's me.

Swansea Indepenent Poster Of The Year 2021. Dr P / Mart66 / Roathie / Parlay / E20/ Duffle was 2nd, but he is deluded and thinks in his little twisted brain that he won. Poor sod. We let him win this year, as he has cried for a whole year. His 14 usernames, bless his cotton socks.

Not my area either but surely the whole point of a contract is that it has to be documented in some way that both parties agree to the terms and conditions? You usually need a signature or some kind of audio recording or electronic record like a “click here to accept terms and conditions” sort of thing?

If there’s no record of a party entering into a contract how on earth can it be enforced as a contract? If a person is dyslexic or a foreign speaker and can’t read the signs then are they still unknowingly entering into a contract? This sounds like a very unethical practice to me.

Worked with a chap in Port Talbot he got caught in Newport speeding think it's the second most grossing camera in uk anyway he had notification in post brought it into work our shift manager in the Harbour said just ignore well he took his advice in the end he had to pay 800 quid for I think was a 80 quid fine

Well a fine issued by the police or council is obviously different to a supposed breach of contract that nobody has signed for parking in a free car park.

You can't ignore a police fine, and councils themselves have no authority to penalize. With council notices, you can almost guarantee something will be wrong with the wording. I have done it myself, challenged one and I won. No appeal, just a challenge
