just checking at the end of a fixed term tenancy.
How much notice do i need to give.
Say it began on 28th Feb & ended 28th August.
Do i need to only give 1 month?
This section;
3. The Length of the notice must be at least two months and notice may be given before or on the day which the fixed term comes to an end
does this mean I would have to give 2 months and won't be able to move out until September? I thought I tenant only have to give 4 weeks?

Just for interest, as I never knew this. You don't have to give any notice at end of fixed contract, just if you move to periodic tenancy.
If you have a periodic tenancy, you have to give one months' notice in writing (or longer if you pay your rent less often). The notice should end on the day that your rent is due. Once the notice ends your tenancy ends and you no longer have any right to live in your home.
If you have a fixed-term tenancy you will only be able to give notice during the fixed-term if your tenancy agreement says it is allowed. The length of notice you have to give depends on what your tenancy agreement says.
It is also possible to leave on the day your tenancy ends without giving any notice. However, it is advisable to notify the landlord that you intend to do so, as this may help to avoid arguments about the return of your deposit. | | | |

I am completely confused. Doesn't the term "fixed contract" imply the dates are fixed? Why would you need to give notice you were leaving if the contract had just expired? The fact you no longer have a contract would give the game away, no? [Post edited 1 Jan 1970 1:00]

yeah i still thought you had to give them a bit of notice to arrange check out etc, but the lettings agent at the new property confused me, by stating I would have to give two months notice, if I wanted to move out at the end of my tenancy.

If no parties have submitted notice to end tenancy then it is accepted that the agreement will move to a month to month basis.
If you haven't heard from your landlord by now, they cannot legally expect you to leave until the end of Sept.
If you do not hand on your notice by July 28th, you will be expected to pay rent for another calender month.
Documents to give notice need three or so days to be processed, so you'd better get cracking if indeed you want to leave on August 28th | | | |

I think you are talking about periodic where as the OP was fixed contract. With fixed contract it end when it ends for both parties. However if you want to quit early there will be a notice period and often a charge.

Tenant ending Assured Shorthold Tenancy (usually 1 year or 6 months) :
If still within the fixed term the tenant will have to give at least 2 months notice in writing prior to the expiry date. If the tenancy is a rolling contract (after the fixed term and not having signed a further tenancy) the tenant is required to give 1 months notice.
The tenant has the right to remain in the tenancy until the landlord evicts via the courts - obtains a bailiff warrant. Court fees will apply.
