Just attempting to tap the remarkable resources this board somehow manages to bring together.

My employer is outsourcing checking driving credentials of those of us who use (our own) vehicles for work.

They want us to use the AA Drivetech web site to input lots of information driver no. Insurance details which basically gives the AA a mandate to root around through the DVLA web site.

Having been the victim of two identity theft cases recently, I'm loathe to give my details out to (yet another) third party, no matter what Data Protection Act compliance they proclaim.

Offered sight of original hard copy documentation (as I have allways done in the past) to my employer and furthermore a DVLA Driver Check code so it can be seen to be up to date.

Nevertheless employer is weilding big stick and making mutterings of Disciplinary action for failure to comply.

Sure their is no mention of disclosure to third party in contract of employment, any thoughts on requirements?

I run a company that do these checks and all they are doing is accessing your DVLA data which is very straightforward and can be done by you right now. Just put in " check my driving licence" into Google and then go to the government website that comes up first in the search and the click "start now" and away you go. This is exactly what you employer will do and is just a quicker way of having to phone the DVLA which they used to do.

They want full disclosure of details Licence, Car, MOTD, Insurance to the external third party (DrivTech) and that is what I object to.

I have offered to give sight of originals of documents and to raise a DVLA Driver Check number for my Employer to use but they won't even consider that.

Use of external third party to check (and have an awful lot of personal information) is my issue.

13 years man and boy. However, one moved on from lawyering so you might find the following more useful than my efforts of recall and certainly before you take any action(s). If you're in a trade union, consult them and if you're not in a union, then you should be! Check your house contents insurance if you can claim use of the access to a lawyer for advice or, call the C.A.B. or a local law centre.

My initial thought, is your employer under some legal duty to comply with enhanced checking/authorisation purposes? If they are, then their request might not be seen as excessive or unreasonable by them.

Your 'refusal' if I can use that word, might be understandable in view of the reasons for your concerns i.e. identity theft. However, that might be pushing it because of the duty your employer might be under and/or while your concern of 'identity theft' is understandable, can you prove that you're going to be the victim of identity theft with the AA any more than you would be by any other form of theft?

Employment Tribunals are not forums for any or all issues in the workplace and on the facts you present, I doubt this would be one they could hear i.e. the mere threat of a disciplinary for the reasons you state.

I think you are entitled to ask for assurances about the level of protections available but my gut feel, you will probably have to comply.

However, if it were me then I would write to my employer (so you have something tangible then word of mouth) stating; that I have no problem with providing the information, that I had offered the hard copy/access to the DVLA data and that in 'discussing' the matter as you currently are, my main concern is what guarantees my employer can offer in terms of protection from identity theft from a third party. I'd also ask, how they can ensure I will avoid the potential for nuisance marketing/selling my details to third parties etc..

Just some initial thoughts and while that's what I would do, if you intend to front this out, then you should seek advice from those currently practicing in employment and/or data protection (might be worth calling the data commissioner's office for advice).
