Sure - but an independent tribunal convened by the FA is unlikely to impose a penalty stiffer than the "prosecutors" (ie. the FA) want. So if the FA want to avoid messing up the play-offs, and they say that they don't think the penalty should exceed X, then I don't think the tribunal would impose a penalty greater than X.

One (good!) thing - the FA can't refuse leave to appeal on a Misconduct hearing:

Regulations for FA Disciplinary Proceedings - 9.4:

"Participants and The Football Association shall have the right to appeal a decision of a Regulatory Commission to an Appeal Board. Such appeals shall be conducted in accordance with the Regulations for Football Association Appeals. There shall be no further right of challenge in respect of decisions of the Regulatory Commission, which are otherwise final and binding"

The Regulations for FA Appeals then provide a time structure which can run for 3-6 weeks. So any appeal would certainly mess up the play-offs. And also (though if we lost the appeal too this would be a massive long shot), I think that clause doesn't exclude the possibility of judicial review of any decision/appeal, so there's a further possibility of legal action.
