| Police Corruption prog tonight on 00:09 - Apr 16 by controversial_jack | I fail to see what getting details has to do with any current offence they are being suspected of. Suspicion itself is not a cause unless they actually suspect you of any crime. They can stop you and ask to account for your movements and even search you, although you don't have to give consent They will then find you have nothing on you and not going equipped for burglary It's bluff, and intimidation, it's how they work. if they were going to arrest him they would have done so regardless of details. You cannot talk yourself out of an arrest. At every encounter with police , they attempt to get your details whether you have broken the law or not. Say nothing at all to them, they have nothing on you, unless of course you have been a naughty boy |
I did explain why details such as name, dob and address help. Antecedents. Quickly checked over a police radio in one minute. You have to realise it’s very simple. If you are in the area or vicinity of a crime which is being investigated, in this case burglary and you are asked for your details for reasons to either prove or disprove your involvement ( and to avoid being arrested ) then you have to give them. Otherwise you will be detained and taken to a police station to ascertain those details via live scan or other means. It’s the law. Whether I support it or not matters not, it’s how the law works. I’m afraid on this occasion your response is all over the place, and without foundation. An example ‘ suspicion is not a cause unless they suspect you of any crime ‘ Think about that for a moment. It doesn’t make sense mate. And as stated if you say nothing at all to the police on being questioned we go back round the circle and you get detained as I’ve explained above. You have made a reference to going equipped for burglary ( it includes any other theft or cheat ) that’s a normal S1 stop and search with grounds, objective, the officer identifies themselves, entitlement to a search record and the time they have to collect a copy from a police station. Nothing to do with a stop and questioning under S25 whilst an officer is investigation an offence. A little knowledge is dangerous at times, and of course with a degree of personal bias, we all have it. The very reason for not arresting someone is because they are given an opportunity to personally withdraw themselves from any suspicion by answering three simple questions. I'm unsure where the issue is. Unless of course the real issue is you dislike the police, and that’s got nothing to do with being stopped, detained or arrested, it’s just a persons preference which generally causes these situations to explode when a bit of humility would work far better. Anyway, good effort mate, I’m off to bed..ðŸ‘😉

But nine times out of ten there probably wasn't a crime in the area just flexing their power and we have got rights...you don't have to give details unless you have done a crime...otherwise wrongful arrest.

| Police Corruption prog tonight on 21:55 - Apr 15 by raynor94 | Bloody hell, have you got a suspicious face? There's a pattern beginning to emerge here |
Some may say , but my dear old mum loves me . Before I start I respect the law but appreciate that its manipulated sometimes by by those who are tasked to uphold it and surprisingly enough there are quite a few who don't know or ignore it to suit their own ends Stop and question: police powers A police officer might stop you and ask: what your name is what you’re doing in the area where you’re going You don’t have to stop or answer any questions. If you don’t and there’s no other reason to suspect you, then this alone can’t be used as a reason to search or arrest you. Stop and search: police powers A police officer has powers to stop and search you if they have ‘reasonable grounds’ to suspect you’re carrying: illegal drugs a weapon stolen property something which could be used to commit a crime, such as a crowbar You can only be stopped and searched without reasonable grounds if it has been approved by a senior police officer. This can happen if it is suspected that: serious violence could take place you’re carrying a weapon or have used one you’re in a specific location or area Before you’re searched Before you’re searched the police officer must tell you: their name and police station what they expect to find, for example drugs the reason they want to search you, for example if it looks like you’re hiding something why they are legally allowed to search you that you can have a record of the search and if this isn’t possible at the time, how you can get a copy Removing clothing: police powers A police officer can ask you to take off your coat, jacket or gloves. The police might ask you to take off other clothes and anything you’re wearing for religious reasons - for example a veil or turban. If they do, they must take you somewhere out of public view. If the officer wants to remove more than a jacket and gloves they must be the same sex as you

I used to get regularly stopped on my Bike going into Wales .Heddlu Gogs hate bikers coming in and getting killed on their roads, making the stats bad and putting their Chief under pressure at the next Meeting. I had them measuring my number plates, checking exhaust etc and the fact I was a serving police officer actually made no difference.Merseyside Police far more relaxed as regards speeding although enough camera here too,but nowhere near the proliferation in Swansea and south Wales. Ive been stopped in the Tunnel before and after working nights and been bagged after some jerk ran into me. It's all about attitude. You act furtive ,suspicious or evasive and you will attract greater scrutiny, whatever your colour or ethnicity. Fact. As a kid ,I had plenty of whacks of them. It's called growing up and sad Police no longer can raise a finger of naughty kids and instead imply process them leaving them with a criminal record or caution. You cannot replace the Police.

Suspicion in itself is not a cause for detainment etc, otherwise they could detain any person at anytime for the way they look. Admittedly, if you are doing something dodgy then fair enough. Why would your details link you to any current offence.Giving your details does does not prove any involvement There would have to be reasonable grounds for a stop and search, which i'm sure they can find. Just walking through an area where there has been an offence isn't really good enough or I would never go to Neath again As i stated, if they were going to arrest you they would, regardless of your details or not.The police try to get your details at every opportunity. To do this they will try bluff, intimidation , and even giving you incorrect information. I'm aware of the stop and search procedures, where they have to give you a solid reason for it and give you a copy of the search. This prevents unwanted or unlawful searches, in theory anyway. I would not give my details simply because I don't want to or have to,and I don't want my name on any police computer as I don't trust where it goes and how it's used.not because I don't like the police. If they want my details they will have to arrest me. If i'm innocent, I will call their bluff every time.Any unlawful arrest will then be pursued by me through legal means.

Not confused, simply gut reactions. Some people simply feel aggrieved if spoken to by Police for any reason. It's that simple. They cannot operate without information and that is obtained by opening the gob and asking questions. Nobody these days will ever admit a crime unless they are insane or stupid. Ergo,Police cannot trust anyone at face value. Again ,simple really. And for what it's worth, being in the Job is no guarantee of not being spoken to ,quetioned or ,of you like, breathylsed. I seem to recall a few run ins with West Midlands Police when visited the like of Wolves. You get on with life.

Your knowledge against someone who taught criminal law for 15 years and practised it for over 34 years I’m afraid is lacking, you have skewed thinking based on watching too much tv. What you’ve been told is completely accurate, your responses are ridiculous and as keith said make no sense like your latest one. You are telling him things which are only in your mind, which is fine, but maybe it’s best they stay there as they are tiny fragments of misinformation.

Then no disrespect, but I wouldn't employ him for my defence. I have a family friend who was dragged through the courts convicted of a sexual offence, had 5 years prison. It was overturned later, because of no evidence. but not after he lost everything. He said, SWP are the most corrupt of all and the solicitors are cap in hand with them. He said go to England don't employ one in South Wales. Annecdotal to many in here, but it's something i would consider [Post edited 16 Apr 2021 11:18]

I said I wouldn’t respond 😂 However, for the benefit of those with an interest here, I’ll answer your questions. These are practical answers regards your belief system, no offence ( as you said ) Sometimes people don’t like the answer to questions, however that doesn’t change the answer. Here we go. Suspicion in itself is not a cause for detainment etc, otherwise they could detain any person at anytime for the way they look. In law the police are not allowed to stop you because of the way you look. Suspicion is a cause for being detained Why would your details link you to any current offence.Giving your details does does not prove any involvement In relation to a stop under S25, as I have explained and it’s not just for details, if a person is stopped and intelligence is provided they have previous convictions for burglary, or are active in a particular area then it’s helpful. If you have nothing to hide, you have nothing to hide, being arsey will only result in conflict. You can be stopped under s25 for a number of reasons, littering ( which the public hate ) in fact for any offence that is able to be processed on the street. it could be in order to give you a summons on the street for cannabis possession, or urinating, pick a topic, you have to give your details or you will be detained until a name and address is obtained which is necessary to serve a summons. That’s the law There would have to be reasonable grounds for a stop and search, which i'm sure they can find. Just walking through an area where there has been an offence isn't really good enough or I would never go to Neath again. A stop and search is not a S25 stop, that’s a s1 stop and search which I have already answered. I quite like Neath As i stated, if they were going to arrest you they would, regardless of your details or not.The police try to get your details at every opportunity. To do this they will try bluff, intimidation , and even giving you incorrect information. If this happens it’s inappropriate, why use these tactics when you have a simple law under s25 or have enough information to arrest someone. It’s Pointless. It’s worth thinking about I'm aware of the stop and search procedures, where they have to give you a solid reason for it and give you a copy of the search. This prevents unwanted or unlawful searches, in theory anyway. You cant be aware of them fully, which is where the misunderstandings arise, s25 and s1 are completely different I would not give my details simply because I don't want to or have to, Under s25 you have to, the next step we have covered and I don't want my name on any police computer as I don't trust where it goes and how it's used. There are procedures you can go through to get disclosure If they want my details they will have to arrest me. If i'm innocent, I will call their bluff every time. Then you will be arrested or detained for failing to give your details under s25 Any unlawful arrest will then be pursued by me through legal means. You can’t be unlawfully arrested under s25, you are arrested or detained solely to obtain your details for a summons or to identify yourself at or near the scene of a crime. Unless you can prove an officer went about his business unlawfully, as I explained what’s the point ? they have the law in their favour, and most law abiding members of the public are happy to help Trust issues are everywhere Have a good un 👠

Which is incorrect. As I said a little knowledge is as dangerous as none at all. You are talking about s24 powers of arrest which incorporates s25 powers under Code G of PACE. We were trying to ascertain AJ's issue under general arrest conditions, it takes a little more than an internet Google search to understand. I can find info on the internet that states the moon is mostly made of cheese, I’m not sure it’s true mind. As for the actual reality of law - That's why people are paid good money to ensure appropriate implementation. If you are going to debate, at least have some armoury. You are referencing certain sections of the act regards powers of entry under soca 2006, completely different and not about this subject. You can say what you like from here on in and copy and paste whatever pleases you. Internet barrack room lawyers are everywhere. BTW you are a decent poster, no offence intended. However, a challenge is a challenge. But do try harder, the law takes years and years to understand, the practical side of it probably never 😉
