EFL Outcome 06:39 - Sep 5 with 9349 viewsUpTheDaleNotForSale

From a few snippets in interviews etc, we believe the EFL are ready to show their hand as early as this week about our situation. Its ridiculous that it has taken so long, and feels convenient for them that the hard work in stopping the hostile takeover was completed by the board before this point, but we are where we are.

Looking at their previous investigations, hearings and outcomes, they don't seem afraid to put all of their findings and evidence into the public domain... so it shouldn't be long before we know exactly HOW this happened, WHO is responsible, WHAT they were likely to get out of it, and hopefully WHY Morton House, Andy Curran, Matt Southall et all were so desperate to get their sordid deal for RAFC over the line.

Good Luck to Simon, the Board, the Trust and everybody else associated with finding and collating the evidence to hopefully bury the people behind the failed hostile takeover.

As you suggest, the timing is very convenient for the EFL.
They're nothing but a bunch of cowards.

It will be interesting to know which of the ‘Players’ will actually be up in front of the EFL. What we know for sure is that the Football Club and an Ex director have been charged, along with other individuals.

We know non of the existing board have been charged, which suggests the clubs charge related to actions taken by the previous board. Given the fact an ex director has also been charged we can guess who and what that is about.

But what of the other individuals?

Morton house stated they had not been charged but that doesn’t mean their Directors haven’t ……. Whoever they are.

Andrew Curran and Daryl Rose applied for owners test and we’re the one interviewed so will they have been charged? Given they have had their fingers burned the likely hood of them getting involved in football again is zero , therefore any charges against them may be irrelevant, other than possibly vindicating the club.

What of Southall and Javis? Will they be implicated or charged. These individuals are serial offenders when it comes to trying takeover clubs. Will the EFL look at their involvement and decide to take action or will the emerged unscathed?

The club will undoubtably face some sanctions if rules have been broken, even if it was done by others in the clubs name and against its wishes. How hard the EFL comes down on the club reminds to be seen.

Will other authorities also have an eye on the EFL findings?

The findings of the EFL will go a long way in explaining what went down here and hopefully vindicate the actions of the current board and the trust in saving the club, and lay bare where the blame squarely lies.

We can then finally put this whole sordid affair behind us.

I think the EFL will take the easy option.

- Token fine and/or suspended points deduction for RAFC
- Come down hard on Blackbridge (already folded)
- Come down hard on Morton House (likely to fold once the shares money has been taken back out)
- Some sort of action against Bottomley (likely to be 12m ban from EFL involvement, including time since he left the club)

They can say they've taken action and shown decisiveness, when in reality there will be little to no actual impact for anybody.

You won’t be to far from the truth I suspect. As a regulator they will never be fit for purpose.

The important thing for us will be they publish details of their findings in full.

If that does happen, it will probably be retrospective (or suspended) and a token gesture of 1 point.

It's the next chapter that I wait for. What happens to the main players in terms of the legalities of what they did and the part(s) they played in the plot to bring the club down?

They cannot be allowed to walk away scot-free without having answered to the law for their respective roles in the chaos and carnage they caused. There HAS to be a message to all these kinds of chancers, that your devious actions will have serious personal consequences.

Whether it be civil action or criminal proceedings, they need to be seen to be held accountable and not just in an EFL report, where the sanctions will be of no punitive use whatsoever.

Let's hope that HMRC and GMP are kept busy in the not-too-distant future.

I am assuming that the club has insurance in place for the actions of its Directors and Officers. Might help if somebody is found to have acted illegally

Surely we wouldn't get a points penalty. The club didn't benefit at all from this debacle, in fact we were penalised with a transfer embargo before the start of last season.

I hope you're right, but all options are open to the EFL, who are not always blessed with common sense.

Hopefully they will want to make an example of the main players in this whole debacle. To warn off any prospective payroll companies who fancy buying a football club to asset strip.

I wonder if we will get a suspensed points deduction.

They are still listed at Companies House and nothing listed in the London Gazette.

Swindon got done over similar factors by the EFL, in connection to the previous owner (an associate of Curran) and not the present owner/board and they got a 3 points deduction suspended for 12 months.

So we can hope at worse we are dealt with in a similar fashion and at best, the EFL do not penalise us at all, but deal with the previous directors and the shysters, who actually treated the EFL with utter contempt by banning them from being involved in football.

"Morton House" really have made the EFL look like fools over the last year. It was last August I think where the EFL announced that they were not co-operating and then only earlier this year where the EFL actually got around to charging "multiple individuals"

In that 13 month window "Morton House" has managed to

Turn up.
Buy a large number of shares in an EFL football club.
Stick two fingers up to the EFL when asked to follow the rules.
Sold those shares in an EFL football club
Leave.
Closed down their website.

I was thinking about this question:

Can anyone point me to an individual who has been banned by the EFL ever?

Even Steve Dale and Stewart Day, I don't believe were ever held accountable even retrospectively for any breaches of EFL rules after the collapse of bury fc.

The bury fc debacle says to me that all the EFL's rules were all followed to the letter and so there was no one to blame but the EFL themselves. Not one bury fc officer has ever been condemned by the EFL even 3 years after their failure..

If you look at the number of clubs over the last 5 years that have been targets there is one consistent theme and it is this:

The EFL are weak on the individuals that perform these sorts of operations to damage EFL clubs and the wider game for their own financial benefit and can't lay a glove on individuals whilst being very public on the clubs that are damaged by their lack of ability to effectively and properly regulate.

We look like we have been very lucky to have avoided "Morton House" but the next EFL club won't be so lucky and whilst individuals are free to roam.

Blackpool - Oyston & Belokon?

Blackpool - Oyston & Belokon?

https://www.theguardian.com/football/2018/mar/13/premier-league-blackpool-owen-o

Oyston argued the toss for years judd. As the above shows he started the arguing as he got Blackpool into the Premier League, the Premier League did nothing and then when Blackpool were relegated back to the EFL he continued arguing.

"He proposed instead agreeing not to be involved in any substantial management of Blackpool without consulting the league. Scudamore, however, said the board did not consider that acceptable and insisted that Oyston transfer his shares. That never happened and within weeks Blackpool were relegated. The Premier League is understood to have told Owen Oyston it would require him not to be the owner if Blackpool were promoted again.

Last month Karl left the club and other Oyston companies following a serious falling-out with his father over the handling of the Belokon legal action. Belokon has the legal power to enforce a sale of Blackpool and any other Oyston assets but he is barred from being an owner or director because of a criminal conviction in Kyrgyzstan, in his absence, for money-laundering.

"Belokon said in a statement that he contested the validity of the conviction, claiming it was politically motivated and “ignored the most basic principles of natural justice”. He said he was working to persuade the EFL that “there are obvious and compelling reasons why I should be considered to be a fit and proper person under the EFL rules”.

Share sold. EFL did nothing. EFL could do nothing to the individuals.

Oyston made millions out of Blackpool all on the EFL's watch.

Recents high profile events will give the EFL the opportunity to delay and pronouncement for at least a further 10 days, should they decide to take it.
Lord knows the financial arrangements behind the failed bid are very difficult to work through, but this is now getting beyond ridiculous.
They need to wake up and start delivering on their remit to provide firm goveranance. They would be out of jobs by now in any other industry.
