What's especially sad about this is that the bloke from the band Spirit who wrote the song didn't sue in his lifetime, which suggests he wasn't bothered. Then he dies in 1997 and some years later, a trustee of his estate sees dollar signs and launches the legal action. I hope his legal costs take a big chunk of the estate out of his greedy hands.

There has to be inevitability of familiarity/coincidence where something sounds similar without copyright infringement intent....No finer example than the descending introductory chord arrangement of The Jam "In the city" and Sex Pistols "Holidays in the sun".

Yeah, I think definitely a case of months and not years i.e. 1977. I think The Jam got in first!
