Pity the Arab states did not support the UN mandate back in 1945/46 which created the two state solultion. They all refused to recognise the state of Israel. Egypt invaded the gazza strip and Jordan invaded the West Bank both of which formed part of the new state of Palestine.
We could have had peace in the middle east without the loss of life in the various Arab Israel wars and the countless deaths fighting terrorism since. | |

I don't suppose many will bother to do more than skim this article but I found it very interesting. It supports the argument that judges are veering more towards activism than restraint in certain areas. The notion of a separation of powers where Parliament (the legislature) makes law and judges (the judiciary) determine whether law is being applied as Parliament intended, seems to be increasingly challenged. Many of us are all too familiar with the idea that the UK's international treaty obligations have limited the government's ability to change rules in areas like immigration policy through new primary legislation, but assumed that if we withdraw from agreements like the ECHR this will become possible. The important point made in the article is that those who oppose this (see: Hermer, Grieve et al.) are increasingly claiming that the common law will still stop new legislation changing the status quo. Common law, also known as case law or judicial precedent, is law derived from past court decisions rather than Acts of Parliament. According to Dickson's article: "the Supreme Court may be quietly positioning itself to resurrect the common law as a source from which to develop human rights law in ways which will prevent much of a gap from opening up between the British way of protecting human rights and the Council of Europe's way." Things have moved on since 2015 when this article was published and the issue is now highly topical, especially given the Home Secretary's recent statements (and what she may say tomorrow). My own view is that judges should stop trying to stretch their role of "interpreting" law to mean making law, and leave this to elected politicians who are subject to the democratic process.
