The trouble with imposing a harsh sentence is that it raises questions about relativities compared with the fate of other offenders, and will add to a growing public perception of lack of even-handedness. [Post edited 2 Sep 2024 14:00]

Looking at the sentencing guidelines it seems she'll get about 3 years. https://www.sentencingcouncil.org.uk/offences/magistrates-court/item/racial-hatr With the additional aggravating factor of the social climate at the time she could get more. Initial impression would suggest it's harsh but what she tweeted was awful. She won't do it again I wouldn't have thought.

The post was unpleasant and unwise. but to me two factors offer some mitigation. First, this was not an action with immediate and tangible consequences, as might have occurred had this woman shouted something similar in the crowd outside an hotel under attack. Second the "for all I care" phrase slightly dilutes the force of the apparent incitement to violence. In the USA the courts use a "clear and present danger test". This means that: "The question in every case is whether the words used are used in such circumstances and are of such a nature as to create a clear and present danger that they will bring about the substantive evils that Congress has a right to prevent. It is a question of proximity and degree."

Second the "for all I care" phrase slightly dilutes the force of the apparent incitement to violence. We will have to disagree on our interpretation of the English language there! I would say "for all I care, " means I care not at all for any loss of life incurred by following my encouragement. It only needed one person to take the poisonous statement seriously, just one that's all!

Tyler Kay was sentenced last month to 38 months for sharing her post. The prosecution case against her, also includes evidence which showed that racist tweets were sent out from her "X" account - both in the weeks and months before the Southport attacks, and for many days after!

It is fine to disagree. My comment rests on the argument that there is a difference between the following two statements. Kill those F....... B........s. You can kill those F_______ B_____s for all I care. Although both are worthy of censure, I believe there to be a difference in the strength of the incitements. As to whether "it only needed one person", there are the issues of immediacy and proximity that I mentioned. I did not follow this 41 year old woman's tweets on X and doubt that persons on their way to the riots were reading them. As the OP suggests, a punishment might well be appropriate after due process, but to my mind a 3 years sentence is OTT. I notice that some of our US cousins are saying this would not have been an offence in their jurisdiction. [Post edited 2 Sep 2024 17:02]

Keith lost me for a moment too, but I think this is what he had in mind. I thought the link was being made to how well the hidden cameras in the other case were installed. https://www.sparkyfacts.co.uk/Guide_to_the_AM2_Exam.html

I knew it was a joke - but just not what kind of joke. Coincidence then that there is a real AM2 and it has a 2nd part that might well apply to cameras.

That is a very substantial sentence for an online social media post. We shall have to see how sentences for cases coming through for people on the Left/Palestinian side, like Ricky Jones, compare.

She’s made a number of tweets and has pleaded guilty to intending to stir up racial hatred. Her sentence is broadly consistent with others involved in the disorder. It’s my belief she’s only got herself to blame. People need to think about what they do and say online. If Ricky Jones is potted, he should have a similar, if not greater sentence.

It would be interesting to see his interpretation. He’s often held up for the Big Brother thing but he also wrote extensively on the dangers of nationalism.

Prople need to accept responsibility for what they post online. Too many people are posting things that are just not acceptable and serious harm can be caused, children have committed suicide through online abuse. You don't need to physically touch someone to cause harm, the sentences should be tougher.
