My guess is, he has certainly met the criteria to be charged with offence of , Offences Against The Person Act 1861, and reckless transmission section 20.

So when is someone possibly guilty of reckless HIV transmission?
You may be guilty of reckless HIV transmission if all five points below
applied to you at the time of the alleged offence:
- You knew you had HIV
- You understood how HIV is transmitted
- You had sex with someone who didn’t know you had HIV
- You had sex without a condom
- You transmitted HIV to that person.

No doubt the defence will focus on that last line. They will focus on any alleged promiscuity. How can they prove if it was Thomas he caught HIV off if he was sleeping with a load of other blokes at the same time?

If what’s being reported is right it doesn’t portrait Gareth Thomas in a favourable light. People have been jailed for passing HIV to others and if what’s reported is true then SWP should be asking Gareth Thomas a few questions.
