🔴 No compensation from Southampton 10:01 - Jun 25 with 4254 viewsKeithHaynes

Just an agreement to let Martin leave.

Nothing on his staff as yet though. And it seems arbitration will be the first step for both clubs if they have a mind to go there.

Just my guess but an agreement couldn't be reached and if they had taken anything it would jeopardise any future payment. As for his staff if we don't agree a figure we can't employ new staff or it would be constructive dismissal IMO.

I have to add, he can’t work at Southampton even though he has been appointed. However, they do have another five days to sort it.

Not suprised by this at all and makes sense considering the dispute.

If Swansea take payment of the least amount then that's them basically accepting that total and makes legal action to get the higher amount more difficult.
They try and sort it out amongst themselves or it goes further and we don't get a penny until an outcome is reached that way........its certainly far from playing a blinder as been suggested by a small few.

There is no doubting they will atleast be getting what was in the contract regards the championship club payment but it's all down to how mush more if any they will get.

So, it was Paul Watson who negotiated with Southampton ! Even though he too was on gardening leave.

- Discussions to extract Martin from his contract were held between Sport Republic co-founder Rasmus Ankersen and Paul Watson, who is still on gardening leave from his job as chief operating officer at Luton Town until July 1 but has approval to work behind the scenes and lead the negotiations for Swansea. Lawyers were involved as both sides attempted to find an agreement.

Bloody confusing really.
Delay was about level of compensation now there seems to be none forthcoming .
None?
It reads that HE walks out on a contract to another employer .
He s either contracted to one club or the other !

So basically despite the people whining about how our club was dragging its heels and should just get it done, the delays were, and always have been about Southampton trying to rip us off.

Pain or damage don't end the world. Or despair, or f*cking beatings. The world ends when you're dead. Until then, you got more punishment in store. Stand it like a man... and give some back.

Yes it seems so.

Watson has been instrumental in Duff coming and the agreements or lack of them with Southampton.

He will be playing a huge role at Swansea next season.

We won't know that unless it goes through the courts.

Soton fans will say it dragged on because Swansea were trying to rip them off for a figure that didn't apply to them.

Soton were relegated but still part of the premiership.......i would be very suprised if we got top amount for Martin in this but I would expect we get a bit more than the minimum.

Not trying to be funny here, just trying to look at it logically and an unbiased angle.

We do know that.

Southampton obviously approached Martin when they were still a Premier League club. The story first broke in mid-May. The Premier League season didn't end until the 28th May. Their relegation wasn't officially confirmed until mid-June.

Southampton obviously knew the terms of his contract before making an official approach because otherwise they wouldn't have waited until they thought that they would only have to pay the lower figure, which basically amounts to tapping up. Commonplace, but still technically against the rules.

What we've been seeing is the usual "Swans management is always wrong" crap. If we hold out for best value, we're dragging our heels and wasting time. If we take the best deal available and get things done quickly, then we've obviously sold too cheaply. People are far more interested in taking a pop than in understanding what's gone on.

I refer you to my thread on PS of a few months ago where I got pelters for saying there was an agreement reached for RM to go in the summer. Southampton could believe that agreement precedes any entitlement the swans have.

Could be interesting.
If Martin did walk out, although that was as a result of the offer from Southampton, it could be argued that it is Martin who should be pursued in law for breach of contract. While unlikely Southampton would escape entirely the sum they are ordered to pay could be less than expected. They may also do a Cardiff and refuse to accept any judgement set against them.
Just thinking out loud.

Everyone is entitled under employment law to resign from their job and take a new one so he can’t be done for breaching his contract personally. I assume he’s given adequate notice since this has rumbled on for so long. It seems everyone has acted correctly and responsibly and done the right thing.

The only sticking point is the fee. Southampton understandably think they should pay the low fee. We understandably feel we are entitled to the higher.

We better hope and pray the EFL doesn’t put Southampton under a transfer embargo for non payment or we’ll never get rid of Fisher.

He didn’t walk out. The Swans wanted to appoint a new manager, and couldn’t with RM still at the club so he was released pending a legal decision on compensation.

So going on that, we can all expect the full amount.

One thing I have learned in life, things are never as clear as it seems especially when it comes too contracts.......so technically and in reality we don't know.

They were at first but fair dos they seem have stuck to their guns.

Soton had less to lose than us as they have amicably parted company with their manager but we had a period where we probably lost a couple of prospective managers and could have lost duff.

Glad that duff is sorted as that for me was the most important part, the Martin saga can draw on, the ball is now in sotons court, they are in a position of uncertainty as they (if i read it right) have to sort compo out for Martin before they can hire him.

Actually I was far more interested in making the best decision for our club. it seems they had to allow Martin to leave with no compo sorted or maybe we wouldn't have gotten Duff to come here?

We want EPL compo, they want to pay EFL compo, maybe we should just have met in the middle because this nonsense isn't good for either club. This was business people on both sides trying to pay the least/collect the most, it was about the money not what was best in the long run.

The first mumbling of trouble was when this forum reported Martin declined to fly to USA. It was clearly stated it was Martin's decision not a US based decision.

a) USA people would not have paid for Martin's flight had they known of SFC interest.

b) If SFC interest was not known to Martin he would have gone to USA.

I therefore suspect Martin was tapped up before SFC spoke to Swansea's Us owners. SFC could argue that Swansea were transitioning to a new management and were unable to inform Swansea.

Silvertein may have been the main proponent of given Martin what he wanted (working on a new contract for example). He would justifiably upset if that was the case.

I hope an arbitration meeting will be sorted quickly and resolved. One days work for £300,000 or so is well worth the effort and temporary inconveniences.

Watson's work is on a laptop and a phone with encrypted messaging. Luton do not care much either way in Watson is already working informally for Swansea while being paid by Luton.

The contract stipulates that in the event of him leaving and gaining employment at another club we are entitled to X amount of money depending on which league they are in.

So yes the contract is important but nobody can be held in a job against their will. That’s bordering on slavery.
