Let’s keep this civil.
Final appeal in Switzerland and the outcome is binding.
Apparently Tan has spent 16 million fighting this.

There is a winding up order in place of Cardiff lose and don’t pay up.
However, I would imagine they will.
I’m told this is the reason Tan hasn’t sold the club. ( Well it would prove difficult )

Yes rivalry aside, this gross mismanagement is an insult to all their decent fans who pay their money to follow the club, only to have it so badly handled.

Cardiff City should have just hired the brainboxes commenting over on their forum instead if the legal teams that are costing a small fortune, apparently Sala is just like an Amazon purchase that went wrong so they shouldn't pay

Way out of my comfort zone when it comes to legal and small print over issues like this .

My question is , and somebody could give me a clear answer is , at the time of this tragedy who was Sala , as a club footballer , under cotract to , Nantes or Cardiff or maybe at that time without a binding cotract to either , for that moment freelance .

If there was no permanent or paperwork stating he was legally a Cardiff City asset then they could have a right , by law , to challenge any compensation package .

Maybe fingers should be pointed at the dodgy plane and its service history , the owners of the company , and unfortunately the decision making of the pilot who also lost his life .

I am sure Cardiff showed Sala signing a contract as well as doing a press conference to announce he was a Cardiff player.

Binding on who, just Cardiff or will Nantes have right to appeal the decision. Cardiff have already had three appeals. Surely Nantes would be entitled to the same.

and ratified by the Welsh FA but I believe not by the PL On the morning of 18 January, Sala flew back to Cardiff to conduct a medical ahead of the transfer.
which was announced to have been completed later that day.
Sala rejected a "huge" offer from an undisclosed Chinese club,
and the signing was completed the next day, with Sala signing a three and a half year contract, but was finalised too late for him to be able to appear in a Premier League fixture against Newcastle United the following day. Sala remained in Cardiff to complete press duties, and was officially unveiled as a Cardiff player at 7pm on 19 January following a 3—0 defeat to Newcastle, with the announcement rushed through to mitigate against fan reaction due to the loss.Cardiff promoted the transfer via social media and released a statement via the club's website titled "Sala is a Bluebird";The Athletic reported in August 2019 that this unveiling was premature, as the Premier League had rejected the payment schedule proposed by the two clubs, with a deadline for a renewed contract set for 22 January.

With the public announcement of the transfer made, Sala's first game was now believed to be scheduled to be against Arsenal on 22 January, before flying back to Nantes to collect his personal belongings and say goodbye to his Nantes teammates.Speaking to Cardiff City's website, Sala described being the club's new record signing as "special".At an inquest into his death in 2022, Sala's mother Mercedes Taffarel said that he had felt pressure from both clubs to complete the transfer, describing the duration of the transfer as "very intense" in a written statement
"CEO & Executive Director, Ken Choo, added: "It’s obviously been a long process to secure the services of Emiliano, but I’m very pleased that we’re now in a position whereby we can confirm his signature and officially announce him as a Cardiff City player."

The way i see it both the plane owner and transport firm had insurance and public indemnity insurance in order to be licenced with the CAA.

Cardiff s insurers presumably asked Cardiff to dispute the sale completion to avoid the long winded insurance claims which could go no for years. This will fail then liability for the accident will be determined and the insurers of the aeroplane and transport firms will have to pay up or at least make a significant contribution. Insurers cannot run away like from and take bankruptcy protection. In the scheme of this this is still a relatively small event compared to hurricanes floods and ship disasters. UK firms are very good at this.

Players valuations are reported on in accounts in terms of transfer fees reduced every year of the contract. (amortisation I think they call it)

I t was an accident. Cardiff city did nothing wrong. I hope they have good insurers.

Amortisation is a reference to debt, for example you will pay £15m for him but pay it over a period of time. Values of players registrations are what have a cost, not the players themselves. You can’t insure a players registration.

As for above the transfer was complete - but they argued the Premier League hadn’t registered him to be eligible to play in the league and that is what they bought him for. He wasn’t eligible to play in the Premier League due to the Cardiff error of paying his signing on fee in a lump sum as opposed to over the length of his contract, until that was amended he wouldn’t have been able to play in the league.

But you can have a player at the club that isn’t eligible to play in a certain league or cup (a cup tied player for example) - but it doesn’t mean they aren’t your player, they just can’t play in a certain league until they meet the criteria.

The subsequent legal costs will not be covered by insurance.

This action is being driven by pride. Nothing more. Tan doesn't see why he should pay, even if everyone else does. He's just dragging Cardiffs name through the mud (not that it wasn't already dirty enough) in the process.

Pain or damage don't end the world. Or despair, or f*cking beatings. The world ends when you're dead. Until then, you got more punishment in store. Stand it like a man... and give some back.

If it was legally documented and on record that Sala was officially a Cardiff City employee then Nantes are in the clear .

If that is the case , it should be now up to them to go after the airline company and try to prosecute them , but , as mentioned earlier they have gone bust .

' From memory though, wasn't the pilot breaking the rules? The plane wasn't fit (nor insured I believe) to fly a commercial journey. No insurance would pay out on that, the policy is invalidated even if it existed '

Cardiff did offer to fly him on a commercial flight but, if my memory serves me right, he didn't accept this and asked his agent to find a private flight. This might be cardiffs case !

From memory the pilot was not qualified to fly at night or in bad weather and don't the authorities think the pilot and player were gassed by exhaust fumes filling the cabin ?

Kaardiff need to pay Nantes, what Kaardiff do after that is up to them but to try and not pay the French team for the player is poor on Kaardiff part.

He himself obviously had reason for concern regarding the state of the aircraft according to flight transcripts , alas too late into the journey to take action .

So perhaps they should be looking at the agents who did the hiring , what reputable company knowingly hires out an uninsured and unmaintained vehicle .

Next time I need to hire a car from Enterprise I will tell them do not bother with the MOT and insurance , I will take a chance on it , one from Pic Up Spares will be ok .

No sleight on Enterprise who I found an excellent company

It's Kaardiff problem, not Nantes.

The case is open and shut who should be left holding the bill and that is Kaardiff.
If Kaardiff want to try and chase a dead pilot's (who seemed to do a bit of hobbling) money or an apparently bankrupt small private plane hire firm then that is up to them.

I have read nothing to suggest the aeroplane was not insured no that the aviation firm few planes without insurance cover. The CAA prosecuted on other matters which did not include flying uninsured.

If the plane was flown illegally because the pilot was not licensed to fly in the conditions, do you think the insurance would be valid.

I’m sure the plane was insured, doesn’t mean transfer fees for registrations of people inside are though, in fact it’s pretty certain not to be the case.

If you have insurance on your Vauxhall Corsa and you crash - but you were giving Haaland a lift as he had broken down on the motorway. Your insurance company isn’t going to pay Man City £200,000,000.

Agree , the main reason it seems to get Sala to Cardiff asap was a PR exercise , photo shoots the publicity and announce a brand new signing to their club ,. According to reports he wanted to stay in Nantes a bit longer to say goodbye to his team mates which meant he could not attend training when Cardiff wanted him for the camera .

An ad hoc plan was put in place to get him over to Wales quickly , did Cardiff know about this arrangement , did they endorse and sanction a flight on an Airfix model with their
marquee signing on board , or did they turn a blind eye , after booking a flight for him .

As mentioned earlier would Erling Haaland be transported that way , obviously not .

I recall seeing Ayew drinking a cola on a very expensive looking private jet to Istanbul to sign for Fenerbahce on loan. That is probably what he was expecting. Probably belonging to the Fenerbahce chairman.

Little old me had £5m public indemnity insurance and £2m public liability insurance working in engineering and I am an ordinary Joe with a van. I had to pay for it as freelancer about £500 pa or could not work.

Public liability insurance protects you and your business against financial risk of being found liable for personal injury property damage and economic loss.

Public indemnity insurance protects you and your business against claims for alleged negligence or breach of duty arsing from an act error or omission in the performance of professional services.

An aviation firm to be able to get a licence would have this cover to higher levels i would imagine. A plane crash in central London would cause huge costs.

The owner was not jailed for not having insurance. When asked by his insurers what services he provided. It would have included "transporting football player and football executives". If he paid £2000 premiums 4 times mine it would cover £20m.

The thought of that unmaintained aircraft and a unregulated pilot could cause a terrible incident over a built up area and on land population , does not bear thinking about .

That’s insurance against getting sued, a completely different thing all together.

You initially suggested that Cardiff had some sort of policy where if their player dies then the insurance covers his transfer fee. That almost certainly is something that doesn’t exist in any realm… anywhere.

Value to a company is subjective regardless of book value (again that value is in the registration which remained in tact, not in the player himself). I made my company in excess of $50m last year. If you were drunk and you crashed while giving me a lift to watch the Swans, you wouldn’t be liable for that lost revenue to the company and your car insurance certainly would not even consider such a claim, even if you were stone cold sober.

As for it being “an aviation firm”, it was nothing of the sort. It was a privately owned plane registered in Norfolk on behalf of someone in the States. It’s untraceable. The asset will almost certainly not be claimed for. It was not a commercial plane hence why Sala didn’t pay for his seat.

A lot of the immediate family died shortly after.

I think his Dad died shortly followed by his sister. Something like that.

Pretty tragic. But Cardiff really should be putting this one to bed now. Idiotic comments by their fans likening him to an Amazon purchase that never turned up is just shocking.

Football transfers is not human trafficking, people don’t seem to understand that you aren’t buying the player, you are buying his registration.

The 'aviation firm' I was referring to was Mr Henderson's firm. An aviation specialist who matched people's aviation needs with aeroplanes and pilots. If his insures get away scot free it would be quit a result for them Cardiff will sue them and the planes owners. They should have massive insurance coverage.
