| This is outrageous, it’s going too far now! on 20:48 - Nov 4 with 1210 views | Catullus | What's the full story? Is the nurse covid free? Does she work for the NHS, if so who looks after mum when she's in work? Is the care home covid free? Only knowing part of the story, it's hard to tell. Remember that nurse who was on the "covid is a hoax" march? When we knew the full story it was different. I mean, what if the mother needs 24 hour care? How frail is she? Has she dementia? I can't just take nattyanne's word for it! | |

Yes, however, they haven’t been allowed to see her for 9 months and want to care for her at home for the rest of her days. Why should they prevent it?

It’s very very sad. The reason for the restrictions is to try and prevent Covid19 getting in to the care homes, which in some areas have been ravaged by the virus. The lack of testing etc meant that visitors can’t be screened. Reading an article in one of the newspapers, it seem the home have legal responsibility for lady and the family only have power f attorney for the finances. I have been made aware of a care home where 10 residents passed away over the course of a couple of days - truly dreadful. I don’t blame the family for trying to get the old lady out. I’d not want my parents to be in somewhere like that.

I imagine it’s a similar situation here and they are breaking the law by removing her from care even though I fully understand their reasons for doing so.

So what is the legal position if the family are not satisfied with the care that a home is providing and want to move her to another home?

That's why I said we needed the full story, as heartbreaking as it must be, the family must have known the circumstances. This wouldn't be anywhere near civil liberties being curtailed because of Covid, this would have happened in more normal times too.

I ran a care home for 25 years. A care home cannot stop someone from leaving if they wish to. They’re paying you to provide care and you can’t force them to continue to do so if they don’t want to. I cannot imagine why any home would want to keep someone whose family don’t want them to be there (assuming they don’t have the mental capacity to make their own decision). This has to be something to do with COVID. This cannot happen under normal circumstances.

It has to be done with the agreement of her doctor. The rules are bloody stupid. She had this wheel chair built for her that was to prevent her getting pressure sores, we would take her out around the grounds in it but she would often slide out of it as it was made of quite smooth leather, she got injured quite a few times by this chair. We suggested fitting a sort of seatbelt that would just help hold her in place so she couldn’t slide out of it and they told us in no uncertain terms that we are not allowed to “restrain her”. So now she just lies in bed all day every day.

Like I said, without knowing the full story we can't judge. What if there is an Adult care and support order?

You can apply to a court to take your relative home. You probably just need to prove they are safer at home than in the care home. It also helps if the relative had full mental functions then they have every right to leave anytime. It is a care home not a prison.

Wouldn't that be the reason she'd get a worse punishment? If she knows the rules and is breaking them, is that worse? It always comes back to needing to know the full story.

You’re right. To pass judgment we need all the facts. If there was a court protection order any change would have to go through the courts and then be implemented. They’re extremely rare.

She was de arrested and allowed to go free. She would have had a ticking off as she did break the law.

Did they mean personal contact , I know when my Mother in law was in a care home in Carmarthenshire we weren't allowed to visit her from early March and it was only when they knew she was about to pass that they allowed my wife to be with her for her last days (of which we're eternally grateful, too many never had that last moment together )
