| Tonda possible ban? 10:56 - Jul 17 with 6521 views | saintpaz | How long are the FA going to take over this? Anyone have a clue? The last I saw was they were going to give a verdict but haven't heard anything since which was some time ago now. [Post edited 17 Jul 11:02]

| Tonda possible ban? on 12:48 - Jul 17 with 6358 views | A1079 | My belief is, that they will announce it the week leading upto the start of the season (first league game) to have the maximum effect and to cause the most disruption to SFC. I know that is a cynical view and hopefully I am very wrong but I don't trust any of them. However, it would remiss if SFC and the board have not considered the worse possible outcome and do not have a plan in place should that happen as they have had plenty of time to consider the options and possible outcomes and the potential consequences. | | | |

| Tonda possible ban? on 14:20 - Jul 17 with 6225 views | SaintNick | The FA havent even levelled any charges against Tonda yet, so they can't give a verdict. They have only interviewed him to clarify the situation, so i would imagine that if they did charge him with anything Saints would then have at least two weeks to prepare their defence if their was to be a hearing. As I have always said it is a difficult one for the FA as they do not actually have any regulations that ban spying on opponents. This is an internal EFL issue, the FA did not get involved in the Bielsa spying case, Bielsa was punished by the EFL as it was there rules he had broken and not contravened an FA rule. The FA are looking at whether any of their regulations have been breached, nothing to do with the spying | |

Exactly. Best to forget about it and focus on the season ahead. [Post edited 17 Jul 14:28]

They can charge him under general misconduct surely? Breaking a rule the club signed up to can still be seen as general misconduct from an FA perspective I imagine.

bit of a stupid comment...we won't be saying that if he gets banned, less time for a manager to sort it all out etc [Post edited 18 Jul 23:40]

The EFL reports to the FA. I have to assume the findings of the EFL will be assessed by the FA and although it looks like the FA are making the big call on any punishment, they will only have the evidence already gathered to work with.

Fairly obviously, the longer it takes, the less likely it is that he will be banned.

I don’t think that follows at all. In fact you could almost argue the other way, ie the FA is having a devil of a job deciding what to do. What IS cast iron certain though is that Dragan Solak has said quite categorically that an additional punishment would be double jeopardy, in other words grossly unfair and unjustified. From which we can infer that he would have no hesitation in taking the FA to court. As I have said before, DS is a billionaire and has bottomless pockets, whereas the FA make well less than £10m a year and simply cannot afford to be tied up in the courts for ever and a day. IMHO therefore, a wrap on the wrists - aka a suspended sentence - is the worse TE will get.

The FA are trying to work out of any ruules actually have been broken and what they can charge Eckert with. The fact that they have not charged him with anything yet, suggests that he hasn't actually broken any FA Rules, Bielsa wasn't charged after his indiscretion, so the FA have to be seen to be investigating. But with the season looming the FA will be aware that they will not be able to get any trial done and dusted before the start of the season, indeed give the time scales to let Saints respond to the charge, presumably two weeks, followed by two weeks notice to the hearing date, followed by a similar time for an appeal process, it would probably be September before it could be concluded. After that there could be legal ramifications etc, so I think the FA will just let this one go, probably because we haven't broken any of their rules

This doesn’t surprise me. The media campaign during the spy issue was relentless, particularly from the BBC who had article after article with have you say discussions with comments that were direct personal attacks on Tonda.

| Tonda possible ban? on 11:41 - Jul 22 with 4142 views | WestSussexSaint | Today FA have charged Saints and Tonda with a breach of rule E.3.1. This is the FAs standard misconduct charge and carries a potential penalty of 1 to 3 match ban and / or undefined fine. The more serious misconduct charge is rule E3.2 which carries a minimum 6 match ban but hasn’t been quoted by the FA or Saints. The club and Tonda have 7 days to respond to the charge and then (assuming there is no new evidence to clear them) the FA will announce the outcome and potentially penalty. [Post edited 22 Jul 11:42]

This is FA Rule E3.1: "FA Rule E3.1 states that a participant must act in the best interests of the game and not engage in any improper behavior that could bring disrepute to the sport. It prohibits violent conduct, serious foul play, threatening, abusive, indecent, or insulting words or behavior. An "aggravated breach" occurs when there is a reference to any of the following: ethnic origin, color, race, nationality, religion, belief, gender, gender reassignment, sexual orientation, or disability." Punishment = 1 to 3 match ban As no FA rule covers scouting training sessions, that's what they came up with. [Post edited 22 Jul 11:48]

1 to 3 match ban would be manageable. Even 1-3 per offence (= 3-9) is survivable. Weren't people talking about a 6-12 month ban at some point, or was that just Steve Gibson?

From talking to people inside the club a permanent ban from managing in England is still not off the cards and the decision will be based as much on us being high profile enough to stop other clubs doing, but low profile enough it won't cause them issues, as anything else.

You'd think Man City would be considered high profile. But, obviously not.

| Tonda possible ban? on 20:01 - Jul 22 with 3346 views | 1885_SFC | I reckon a 3-match ban and £250,000 fine will be dished out. Getting thrown out of the play-offs was the harshest of punishments. We missed out on a day out at Wembley, possible promotion to the Premier League, and all the money and exposure that that would have entailed. The FA have to be seen to be doing their bit in order to keep all the whingeing gits (i.e. Boro/Gibson) happy by adding their two-bobs worth to go with the minus 4 points that we're starting on next season. Anything more than a 3-match ban and £250,000 fine would be utter bollix IMHO. | |
