No matter though is it, anyone should be able to leave their home empty without having scum bags break in and wreck the place, not only that the those who broke in were armed. If Sterling had been there and defended his family with one of more getting hurt or worse he'd be facing chargers, absolutely crazy law. seeing as they had no right to be there.

Still not right though, all you need is a crooked burglar fitter and they're away.

Here is the law. https://www.gov.uk/reasonable- Basically the same as a police man's truncheon. I know a man that was installing safes for Crystal Palace footballers. This as for storage of jewelry and watches etc. Useful if the brake in is in absentia. [Post edited 5 Dec 2022 22:31]

This is out of date. You can use disproportionate force now as long as it’s not ‘grossly disproportionate’

"grossly" . Now then, who defines that? We are back to square one. John,if somebody forces their way into your home and confronts you and wife in the dark with a weapon of offence,Im assuming you will use maximum force with whatever you have available to protect . Its the nost basic stuff. Nobody should have any worries about using ewhatver force is necessary. Grossly is a stupid word to be used in this context. The Law.

I have heard if you use something like a baseball or a golf club you keep in your bedroom to defend yourself, you will be prosecuted as obviously the bedroom isn't the natural place to store these ?

If you carry a baseball bat then have with it a base ball. If you have a Stanley knife then have a piece of carpet nearby If a hammer is in a bedroom then ensure you can evidence some recent DIY nearby . At the end of the day,it is your home and if you leave a hammer in the bedroom ,then so be it. Nobody is being invited to your bedroom;not unles you meet fellow inclined adults on holiday that is. Golf club-Golf ball Hairspray is a decent defence btw

No,. absolutely not. Many reasons why that could be the case. May just be untidy, may have been messing around with it. Nothing wrong at all with having it there. You are perfectly entitled to use disproportionate force. If you say that it had been there for months, just hadn't tidied it away, who could disprove that ? In any regard, it is what you do with it is the question, not what you had there.

Forgive me, it is my fault I've not explained it properly We are nowhere near square one. The law has changed and has given massive leeway for the householder to protect themselves. To go from the normal self defence of 'reasonable force' to not using 'grossly disproportionate force' is a sea change. Your example is exactly why the law changed. It goes further than using whatever force is necessary, you will not be charged unless you go completely over the top, as in burglar being out for the count and you batter him senseless on the floor. with a bat. it is the most basic stuff and the jury will be told that it is the dictionary definition of the word 'grossly' as in extremely excessive. It is the jury who would decide on what is 'grossly disproportionate' the instances of this offence being charged now are very rare indeed. The levels of violence used would have to be very very high. Take it from me, it is an excellent change in the law and offers protection in all but the extreme cases.

A baseball bat is not an offensive weapon per se, there is nothing stopping a person from walking around with a baseball bat, you do not need a ball. The Crown would have to show that you had it with you with the intent of causing serious injury to someone. Something a lot of police and sadly some solicitors don't grasp. You don't need a carpet nearby to have a Stanley Knife in your house or DIY to have hammer.

Fair enough. My late father in law always had a baseball bat in his bedroom. Always worried if he did use it he would be done, like that farmer that went to jail a few years ago for shooting burglars. Will dig out a golf club and a couple of balls from the shed now. TBH they could pinch almost anything from my house. I would do anything to stop them harming me or my dog though Should add my late FIL was a nutter who would have gone too far [Post edited 6 Dec 2022 12:32]
