Shocking story, truly despicable act by a sick individual. Spitting is bad enough at the best of times, but if he had Covid19 they should throw away the key. A young child has lost her mother and the family a loved one.
I hope this was reported to the police in sufficient time for them to securing potential CCTV footage of the offender. RIP. [Post edited 12 May 2020 22:00]

I'm not legally trained but it would seem to me that a murder charge would be appropriate. Manslaughter as an alternative but a very lengthy prison sentence either way. |
In an ideal world, should definitely be manslaughter, sadly, would be impossible to prove.
Crown would have to prove .
1. The spitter has COVID AT THE TIME OF SPITTING
2. That the victim did NOT have it at the time of spitting
3. That the Spitting was the cause of the COVID transmission and that it could not have come from anyone else
All so that the jury are sure.
Pretty impossible.
Civil claim maybe, an assault definitely, possibly an affray. (Using or threatening violence, so a reasonable person present at the scene would fear for their personal safety).
