| Cardiff on 14:41 - Jan 21 by KeithHaynes | Staying with the OP. Spoke to a very well informed bloke this morning over coffee, lovely day by the way. Conversation turned to Sala. He asked the question, I thought Cardiff said he wasn’t their player, wasn’t that the thrust of their claim initially ? As we know it was. He then said, so why would they pursue the players insurance the day after he died if he isn’t their player. I think that sums it up. |
I’m not an expert at all on perjury and all that but surely if they’ve been testifying in various courts that they believed he was not their player then why did they try to take out insurance? It’s a bare faced lie.

As my friend stated this morning, can’t have it both ways.

Cardiff have formally denied the claim that they tried to take out insurance late. That would be attempted fraud. A very serious crime. The "he was not our player " was phase one and failed. This was testing the technicalities. It cannot now be conflated with argument relating to their case against their insurance brokers. They are two separate phases in the process. The Cardifff city management system failed. People found it easier to assume things rather than check anything. The whole episode is sloppy from start to finish. An absence of management. The first point of call for any administrator would be whether the agency they were dealing with were the type of people the club should be associated with.

It absolutely can be used in retrospect. If they claimed openly that he wasn’t their player then they cannot lay blame for someone “not informing them” they had to insure them. Not that they have to anyway of course. You have to be very careful in litigation because often what you say initially ends up coming full circle and closing off avenues for future litigation. For example they aren’t going down the McKay route because their links to him are far greater than Nantes. Any investigation will show the mounds of dodgy dealings that ended up with his awful standard kids playing for the club as some sort of compensation deal. But I’m glad you recognise now that they were just “trying it on” by refusing to claim the player was theirs. Quite awful behaviour isn’t it.

If you want an alleged fraud I ‘ think’ it needs to be a civil action, not sure the criminal attempts act covers an attempted fraud.
