Getting access to phone usage data is controlled by the Regulation of Investigatory Powers Act 2000, it can be a complex and applications have to be lawful and proportionate and can only be approved under certain circumstances, I suspect that for a driving offence it wouldn’t be considered proportionate.

To prove the initial offence the police would have had to show he was using the phone for communication which they couldn't hence the case collapsing.

The police /CPS should have summonsed/charged him with using the phone and the alternative you’ve identified of not being in proper control, but I suspect they’ve dropped the ball. Lampard failed to pay the fixed penalty, time has marched on, I suspect it’s gone beyond the 6 month statute of limitation for a summary only offence and it’s too late to add the alternative summons/charge. Courts are under pressure for time and I suspect that’s not helped, I am not an expert on this, maybe Sir John can be more precise.

Bloody nightmare RIPA, I doubt anyone would authorise it for that mind.You are right there.
Although it’s intrusive surveillance, it’s more about impactive crime and major crime, Good knowledge there though mate 👍

Absolutely they can. It may be that they left it too late to do it as it would have been over 6 months, but case law does allow you to amend it if falls from the same circumstances.
It's not worth it to look at phone tracking. There's backlogs for years for phone tracking in sex and drugs cases. It is not worth it for road traffic.

I used to hate road traffic law.

You're more of less spot on. I believe that the law is changed now re the specific usage of the phone and that is no either longer a defence or it is shortly to be amended.

Smoking a fag is dangerous enough.
Traffic fatalities are no joke and are the biggest cause of death in young men.

Personally,I don’t like people driving high powered cars in urban areas drinking coffee or having anything in their hands .
You need both hands to have full control.

One day karma will strike Mr Freeman .

Our roads are more dangerous due to cutbacks in coppers especially traffic coppers,the ones who drag bodies out of cars crashed by people who are pyssed or drugged .

Depends on whether you like human rights. The right for someone not to be killed by people who really are not concentrating on driving.

Cars are people shown personal little world .

Dismembered babies in cars and countless death messages are something coppers ,pigs to many,deal with. The stuff Joe public can’t handle .

I agree with you. It’s only when you’ve dealt with death by dangerous or due care cases and seen the pics where you realise how dangerous they are

Enjoy it. I grew up watching LA Law, Kavanagh QC and then This Life. All I wanted to do was criminal Law. 20 years since starting, despite my complaining about it, I still love it. Look at the debates I’ve got into on here and the pelters I’ve got off some posters. No one ever gets passionate like that over conveyancing or commercial law. If you’re good enough, you’ll earn a good wage.

Nothing beats doing your closing to a jury and the nervousness when they return with a verdict.

More than happy to dm you if you need any more details, links to people on Twitter in criminal law she can follow etc

Court fines go to the government, fees generated by safety camera partnerships and the police in respect of driver awareness courses etc are reinvested in road safety.

All my daughter has ever wanted to do is Law. She certainly likes to debate, some call it arguing, and we are not talking at moment because of the latest heated debate.
She is waiting to hear if she has been accepted at the college she has dreamed about.
