This could go either way, in fact it could actually assist Boris. The police won’t release the detail of their investigation and I suspect we’ll only have a press release at the conclusion. The only way we’ll get the detail is if it end up in Court. It may be the case people will have committed offences, but they’re at a threshold below what would be necessary for Court proceedings. Unless Johnson is a defendant, I suspect he’ll use the police investigation to try and clear himself and undermine the Grey report. If he is charged, he’ll be finished. The Grey report is a completely different animal to the police report, the former will report findings, the police investigation will be concerned with establishing the facts and subject to an evidential test where the burden of proof is beyond reasonable doubt. |  | |  |

For a successful prosecution it is beyond reasonable doubt, charging decision is different. It’s two tier test, evidential and interests of justice. It’s clearly interests of justice, the evidential one is simply a ‘realistic prospect of conviction’ . (Are the jury more likely than not to convict ) The main issue they have, may not be the parties themselves, but if there’s evidence that staff have been told the delete pics etc, Pervert Course of Justice is likely to follow, possibly Misconduct in Public Office, if he’s lied to Parliament (that bit could be a stretch).
