They claim it’s to protect themselves against government tyranny. The government has apache helicopters, cruise missiles, battleships, near unlimited resources and a massive arsenal of nuclear weaponry. How the hell are Cletus and Mary-Sue going to fight off that with a pathetic SMG they got from Walmart?

Which part? I said nonsense to someone saying that it is not in the constitution that someone can defend themselves. Ages of carrying is not in the constitution. Every citizen has the constitutional right to defend themselves by any means necessary, even a 4 year old. What you are confusing is state law. What you are currently arguing is similar to your daughter about to be raped after going to a known rape hot spot in order to help anyone that needed it - and she stabbed the attacker to death before he could do her harm. Do you think anyone would be saying “she shouldn’t have been carrying a knife, it’s illegal”. Self defence would still be the case regardless of the legalities of what she had in her handbag. I read you’re ‘nonsense’ comment against Prof’s point on the Supreme Court interpretation. I’m not sure comparing the kid to a rape victim is particularly helpful. [Post edited 27 Aug 2020 11:06]

My nonsense comment was him saying “it’s not”, in response to Highjack saying it’s their constitutional right. Which of course it is.

Which is trumped by the law, no? Otherwise, to quote you’re example, we would have 4 year olds taking up arms to defend their property.

No, the constitution takes precedence over state law. The problem is the second amendment is only a few lines long, anachronistic and incredibly vague so it’s kept lawyers very rich for centuries.

Nope, state law does not trump the constitution. Again the constitution applies no age limit to being able to defend yourself by any means necessary. 4 year old cannot buy a gun by state law, but if they pick one up and their house is being burned down or someone is about to attack them they would be able to use it to defend themselves as per the constitution.

Supreme Court defines the interpretation of the constitution. The interpretation is Supreme Court not state-level. Although actions of an armed militia against fellow citizens could be argued to also break other amendments within the Bill of Rights | | | | Login to get fewer ads

So then we both agree the action of using lethal force to stave off an armed attack by a mob against you is someone’s constitutional right and backed by the Supreme Court. Not sure what your point is to be honest.

They were acting as an unregulated militia. They were making decisions on matters of law. They are not defending their property If he was not there, he would not be at risk I think that covers at least breaking the second, Fifth and ninth amendments. If he was a business owner in that town or state he would have some defence. These people should not have been there, regardless of the workings of ‘so called’ protestors As soon it was reported that people in military gear were moving into the area this was highly predictable.

That’s your interpretation. Why he was there was clear. He said prior to this that people have been injured by these mobs and he is there with his medi pack to help and also defend the businesses from being burned down. He said his rifle was there for self defence - which evidently proved to have saved him. The militia is the armed mob taking over cities with a mandate to attack state police. Citizens standing up against lawlessness is not a militia. A militia is an armed group that opposes a police force or army of a state, region or country. You don’t become a militia yourself by defending yourself and others against them. As convenient as I’m sure that would be. [Post edited 27 Aug 2020 11:43]

Make up your own definition A militia includes all sorts of organisations working with and supporting a state in its defence. Essentially any non-professional military. A private militia generally work outside the governance of the state. The self proclaimed ‘Kenshosa Guard’ clearly fit the description. I am sure it contained some well-meaning citizens, But there are also reports via their social media activity on some less savoury elements. Let me state once again I am not supporter of the actions of protesters risking life or damaging property. But they also have a right to protest, which in cases has been unconstitutionally prevented. I would also ask parents would you allow a teenage child to be walking streets With civil unrest carrying a weapon of war? Remember this is not his town.

At the time of writing the second amendment a militia would have been a group of farmers with farming implements or pitchforks. There’s no specific reference to guns or AK-47’s.

Most would have early single shot rifles- One of the successes of the ‘guerilla’ like activity in the war of independence was the range and accuracy of colonial rifles to British muskets.

| Kamala Harris Vs Donald Trump on 13:06 - Aug 27 by Professor | Of course it’s relevant. He just under 18 and a minor in the US. So if if they are no a militia why does nearly every report call such? Even right learning Fox News. Is everyone wrong? They are a paramilitary militia. That is the best descriptior. |
It’s not relevant in the slightest. The standard of parenting isn’t even on the list of issues with this case. One for mumsnet maybe? I don’t understand your question regarding militia. The MSN is horrific in its reporting. That’s like saying if these riots are violent then why are news stations saying they are peaceful? Militia is a clear term, if it’s used by people incorrectly it still doesn’t make it the correct term. Words aren’t defined by how many people don’t understand the meaning of the word. In this instance we are discussing the only argument for a militia will be the armed faction of BLM and ANTIFA, they are an organised group set out to oppose the countries government and police. Protecting yourself from criminals is not a militia. [Post edited 27 Aug 2020 13:17]

| Kamala Harris Vs Donald Trump on 10:37 - Aug 27 by Professor | Not if the express purpose is not self defense or of his home. The law also allows police to stop the carrying of weapons deemed inappropriate or dangerous to a situation. Carrying an assault rifle in civil unrest when NOT in your home state should fall under this. A 17 year old should not be out in a strange city at night, during protests. It’s immoral, stupid and dangerous. I can’t see why you are defending him. |
If those same Cops and their bosses were actually doing their jobs there wouldn't have been any need for those many citizens out with guns. That young man had already interacted with the police, who did nothing to prevent him from going to protect his assigned property. He did not shoot his gun until attacked by others, one of whom had a pistol, which can be clearly seen in some photos.

Why not if the protests are "peaceful"? You can join the army, get married, get a job etc. at 16. Why should he have expected violence? (obviously he was expecting the "peaceful" protests to be violent, that's why he was carrying a gun...turns out that was a good assumption to make).

| Kamala Harris Vs Donald Trump on 10:25 - Aug 27 by Dr_Parnassus | Will you let me burn your home to the ground then? Then I’ll burn your business to the ground in the name of social justice? Seems fair. If I tell you I have haemophilia so any violence against me will result in very real possibility of me being dangerously injured.... you would let me? I don’t think so. If you attack people, burn their homes down and destroy their businesses then expect people to defend them. If that upsets you then tough I guess, it’s their constitutional right. Anyway the 3 people shot have now been identified. Andy Ngo gives a run down:- [Post edited 27 Aug 2020 10:27]

What a coincidence. All of the "peaceful protestors" who were attacking innocent citizens and their businesses/property, and chased down a teenager to violently attack him, all had a criminal record. Incredible that. I am scandalised that they got what was coming to them, mortified. They must have been quite surprised as well.
