Murderer refuses to attend court for sentencing 14:57 - Dec 14 with 6851 viewsJoesus_Of_Narbereth

In what world is this allowed? Murdering scumbag Jordan McSweeney is refusing to come up from his cell and face the court on the grounds that he doesn’t want to have to view cctv of what he did. It’s making my blood boil. He should be dragged kicking and screaming to that courtroom. By his testicles if necessary and if they can find any.

So the old bill have never fitted anyone up who's been executed

Fair play

When we had Cp, it's been estimated about 40% who went through the trapdoor were innocent.

Like I said before, it will never happen. I would never prosecute and defend in a capital case. Overwhelming majority of KCs would refuse. It would be difficult to find impartial jurors, I would imagine a lot of jurors would either refuse to sit or would be very reluctant to convict someone knowing that person would be executed (can you imagine sitting on a jury, finding someone guilty who was executed and them later, evidence was found showing innocence ?)

It is a complete non starter

I would have thought that your job is to uphold the law of the land in the courts, whether you agree with it or not.

If you can't do that for moral reasons...then, find another job, or only prosecute/defend in cases that do not involve murders.

When the death penalty was abolished in many countries, murder convictions increased considerably,,because prior to that, Jurors were reluctant to see someone killed and didn't like to convict them

Thank you for your feedback.

I have defended people who I find repugnant, whose beliefs completely oppose mine as that is my job and as I will always do so.

My point is that I and the very large majority of those with whom I will will
not support a system which had capital punishment. There’s a big difference.

Your last point, is exactly what would happen re capital punishment cases, there would not be people of sufficient experience and quality (level 4 prosecutors) to do these cases. The system which is already jam packed would collapse.

It is a comment on the reality of what would happen.

We’re all freelance. KCs unless paid privately are restricted to what work they can do. Have to have a certificate as they only take on the most serious cases

If the threshold for capital punishment cases were only for the absolute worst of offences then they would be pretty rare would they not?

I have also prosecuted against whom I have great sympathy. Would you say the same there ?

It is nothing to do with morality, it is upholding the principle of justice for all people, that justice is blind and that every person irrespective of what they have been accused of, is entitled to equality of arms.

Who are we to be judge and jury ? Someone may be accused of an horrendous offence but may not be guilty.

I have asked you this before, but what would your ideal be ? Is it that if a police officer accuses a member of the public of an horrendous offence, then they should not be allowed representation ? That the evidence should not be tested ?

That, can I gently suggest, is lynch mob justice. I prosecute and I defend 'without fear of favour' I do it, not caring one jot what the public think of me, I do it to the best of my ability. whilst always having an eye on our key principle, which is integrity to the court and not misleading the court.

So I ask you, sincerely, what you have in place of our system ? Is your solution, having the police investigate, present and pass down sentence ?

If you were wrongly accused of a revolting offence, which on the face of it, was strong and happened to be front page. What should I, as your defence Counsel do ?

Please do not suggest where my morals should be served.

I don’t think that their profession is to uphold the law.

It’s to make sure that convictions are as sound as possible. That means the worst criminals have to have a good defence whether anyone likes it or not.

We also advise people to plead guilty and to cross examine people who they have said to have wronged. Alternative would be them cross examining their own alleged victims.

I know the backstories. I also know plenty who have circumvented them.

One of my favourites was a girl from up North. Leeds I think. Every horrible childhood story you can think of applied to her. Then she fell in with a boyfriend who pimped her out. Several years on the needle and game followed.

She decided to up sticks and move to Swansea. Get away from everything and get herself clean. She managed it. The sense of pride that radiated from her was almost a physical force and being able to help her better herself from there (not that she really needed my paltry assistance) was and remains one of my proudest professional moments.

Ultimately, it's still a choice. Maybe I'm being unduly harsh but it can be done and there's plenty of assistance out there to help people make it. Not many do.

Well done Doc, you should be proud as well.

If you are being charged with something , you have the might of the Police force and CPs against you. It's natural to want to have the best defence possible against this

OHL. Simple question.

If someone is accused of a criminal offence, should they be represented if the people accusing them have ‘the best prosecuting on barrister ‘ ?

Perchy would clearly prefer it if nobody had defensive counsel. Obviously anyone charged and in court is guilty in his mind.

It's quite ironic for all his whining about Jim's opinion of the Police, he seems to have been just the exact sort of copper to induce it.

Pain or damage don't end the world. Or despair, or f*cking beatings. The world ends when you're dead. Until then, you got more punishment in store. Stand it like a man... and give some back.

It's what the police do.They don't arrest ppl if they think they are innocent, Therefore every suspect to them is guilty so they don't need a defence
