| Murderer refuses to attend court for sentencing 14:57 - Dec 14 with 6823 views | Joesus_Of_Narbereth | In what world is this allowed? Murdering scumbag Jordan McSweeney is refusing to come up from his cell and face the court on the grounds that he doesn’t want to have to view cctv of what he did. It’s making my blood boil. He should be dragged kicking and screaming to that courtroom. By his testicles if necessary and if they can find any. https://www.independent.co.uk/ | |

| Murderer refuses to attend court for sentencing on 18:27 - Dec 14 by onehunglow | Leg irons quite simply means prisoner can’t escape easily, like simply jumping out of the dock,as has happened . Court above what ? Courts are there to punish offenders. Courts neglect to punish offenders It’s why folk like me get upset Death penalty doesn’t have to be a deterrent Dr W .It’s about simply allowing a family the peace to know the killer of their loved one isn’t released at some later stage when the deceased can only hope of Resurrection via Jesus . It’s that simple Do not pine or consider for one moment for those who terrorise people and ruin lives I’m not surprised barristers feel this way ,with respect . |
When was the last time you stepped foot inside a court room ? Have you seen the docks in a Crown Court ? How is a minimum sentence of 38 years not a deterrent sentence ?

| Murderer refuses to attend court for sentencing on 18:34 - Dec 14 by Sirjohnalot | I agree with you there but how much more distressing would it be if he disrupted the hearing by talking over proceedings? This person was in the building but refused to come up,from the cells. Practical question is how would they get him there. There’s limited staff in court, they’re needed for other trials and other courts. There wouldn’t be the staff to bring him up and ensure he behaved himself. Reality of our underfunded courts |
Give him a sedative early on to calm him enough, dress him in the orange suit and manacle him to a special wheelchair, put a gimp ball in his mouth and wheel him in to court. Call it revenge John and yes, it is but these kinds of people deserve all they get.

| Murderer refuses to attend court for sentencing on 18:51 - Dec 14 with 867 views | Sirjohnalot | I appreciate that some of my posts aren’t going to be met with approval but I’m just trying to convey the realties of the court system and what can and cannot happen in the future. There is no way the capital punishment will ever return, prisoners will not be brought to court in jump suits or leg restraints. What is needed is more funding so that cases can be heard in a decent time and not 5 to 6 years later. I see this every single day, mate of mine had done a trial this week where the jury, judge and barristers we’re all in court in hats, gloves and coats as there was no heating, adjourned today as the water pipes burst. This is the disgrace, this is the justice. I’m not going to respond to the ‘I hate barrister ‘ jibes. | | | |

The condemned man's weight and height was assessed by the hangman before the drop . A weight approximately the same was used to stretch the rope overnight . All this was to ensure that the operation was carried out meticulously and without any hitches . A lot of people believe that the condemned is strangled to death but the neck is broken by the knot being placed behind the ear so death is swift . Capital punishment was stopped in this country by the hanging of an innocent Welshman Timothy Evans who was wrongly convicted of murdering his wife . Public opinion and outrage eventually prevailing.

My uninformed view is that we will end us with US style plea bargaining, I understand it's already creeping in. Then justice becomes a bit of a lottery.

Yep that’s youth had a gun, and the adult (who had a very low mental, age ): shouted ‘give it to him’ or ‘let him have it’ when the police officer demanded they hand it over. Youth shot and killed the officer. The ‘let him have it’ was deemed to be an order to shoot whereas he said he was telling him to give it up. My mum told me about that when I was about 12. Wanted to be a lawyer from that point as I was fascinated

Yes they were breaking and entering a warehouse in South London I believe . Bentley was very harshly dealt with and was convicted on " being an accomplice " whereas Craig who pulled the trigger got off !! ( Well not entirely - but he didn't swing for it) Caused huge debate at the time .

Not really, certainly, if you’re defending you may ask the prosecutor if they would accept a plea to, eg a lower level of assault (quite often the guidelines overlap) or If you pleaded to eg two allegations of supplying drugs, would they drop the third. What then happens is that it is referred back to the CPS lawyer who will talk to the witnesses to see what their thoughts are. Normally comes down to whether it makes much of a difference to sentence, do the witnesses want to give evidence, the strength of the case, certainly of a plea v the sometimes lottery of a jury trial etc. Normally, if there’s a sensible offer, the things can happen. But it is only done if it is in the interests of justice

| Murderer refuses to attend court for sentencing on 18:30 - Dec 14 by Sirjohnalot | About a month ago, I successfully prosecuted an extremely trauma case where the victims suffered a great deal. I witnessed and was involved in care for the victims throughout, they were kept up to date, explained in detail what was going on, and special measures, were applied for to enable them to give evidence via a live link from their home address. After they had finished giving evidence, I spent well over an hour on the phone with them ensuring they were ok and ensuring that a colleague in the cps kept them up to date. I’ve also seen the care given to witnesses from the witness care unit, even though they’re volunteers and the dedication from the people i work with There’s a lot of dedication for the victims and the courts take it extremely seriously. There’s a lot of crap that goes on but to say no thought is given to the victims is, I’m afraid, is not fair or, in any way true. Defendants are not treated with kid gloves, but they must be given a fair trial which also includes not being treated in a degrading way irrespective of what they’ve done. A court must be above what a defendant has done and has to be impartial. It is there to dispense justice, not revenge. This person was sentenced to a min of 6 months. Hardly kid gloves I’d say. When you’re prosecuting you have to approach a case impartially, with an open mind. You cannot take it personally or ‘hate’ the defendant. For a start you’d not last long and you’d not present the case as well you could |
Well done to you for your kindness you showed to the victims and they're families, not all cases go that way though I've no doubt. I did write out an essay and hit the wrong button and lost it all, decent thread this though. Thanks for your experienced and knowledgeable input, certainly puts things into perspective.

You do a very hard job, John. I couldnt do what you do and yes you should be proud. it's not your fault that this country is on its knees, that's the politicans on all sides who have run this country down for the last 50 years. The justice system, the NHS, schools, fire brigades, armed forces, coatsgiards, environment, pay and conditions, they have all been attacked over the years and the only people to really benefit have been the rich, powerful and politicians. Maybe, given all that it's no surprise quite a few of us seem more inclined to harsher measures?

I completely agree with you. However, if your family member was wrongly executed would you shrug and say ‘oh well’ at least other people who genuinely murdered can’t do it again ? We see in America how it doesn’t work. You’d have jurors refusing to sit on panels, judges and barristers refusing to participate and the backlog would be many many years. It will never ever happen.

DNA alone brings a totally different perspective Capital deterrent was only removed because MPs were told the alternative would be full life . They were lied to. Countless villains ,murderers etc have got literally with murder because of some obfuscation created by defence barrister sufficient to plant seeds of doubt into Jury mindsets . Innocent they were not.

The low sentences are actually a myth. A lot of it is down to poor reporting or people from my profession being too elitist and secretive and not being able to explain to people what happens in court. Papers like the Daily Mail don’t help with the way it reports cases. Using sensational headlines and not reporting the facts. I’ve got a case in for sentence on the 22 December which will likely attract sentences in the double figures where a gang entered someone’s house and the house holder killed one of them. He was never Cher he but they were as they were all armed. Likely to attract press attention but papers don’t explain sentencing guidelines or how they judges are restricted by Parliament. Our prisons are full, a lot of people on relatively low sentences. People are going to prison and they’re all at capacity

I am for the death penalty in certain instances, where there is absolutely no doubt and the criminal is a repeat offender of murder, paedophilia or terrorism. Yes pedo's, I'd string them up. Just call me Jefferies! The problem is that some people are sentenced with absolutely no doubt who turn out to be innocent for reason such as police corruption.

That’s the problem, in order for anyone to be convicted the jury have to be ‘sure’. Problem is jurors get it wrong. Can’t appeal dead.
