Every domestic violence (dv) case proceeds with the knowledge that the Aggrieved Party (AP) may well retract or not cooperate. Courts in order to protect, what are normally vulnerable people will proceed anyway even if the AP does not turn up or does and gives evidence for the defence, saying it didn’t happen.
The way they do this is to use the 999 call or the first account given to the police on their bodycam. However, the court say that it can only be used if the maker ‘was so overcome with emotion that it discounts the possibility of concoction’. Judging by what the police encountered when they attended, that’s how they’ll likely proceed here.
She’d have a right to bail unless there’s substantial grounds to believe she’ll not attend, commit further offences or interfere with witnesses. There’s bail conditions in place to stop her committing further offences I.e. assaulting him again.
As the trial is in March, it’ll be in the Magistrate Court, not the Crown.
DV against men is quite prevalent but they’re worried about reporting it as they’re often made fun of. Happens a lot. |  | | |
