| The action taken by Swansea City Supporters Trust 10:16 - Nov 21 with 18645 views | KeithHaynes | It’s been an interesting topic for sure, which does sometimes spill over in to other threads, and understandably so. I've taken some time out to look at the specific action taken. It’s my understanding that this is very clearly down to specific issues around the weeks leading up to the sale of the club by the old board. The exclusion of the supporters trust in the sale and despite the trust wishing to be involved were excluded. That’s the basis of the action. For it to be a valid action the statements of truth gathered by the ( plaintiff) other words are used to describe them have to have some depth in law. Clearly the trust haven’t gone ahead to freeze assets and this is another topic which needs clarification. This action is not against Swansea City FC, as it was then or is now. The claims being brought are not against the club. They are against those individuals who sold the club as they were, not the club as it was, nor as it is now. I think this should be a key area for people to dwell upon. I would have thought both sides ( and there are many sides named because it isn’t one entity) will have already disclosed at least some, but not all of their paperwork similar to criminal cases ( CPIA it’s called criminally ) As there is no fixed date as yet for a trial my understanding is full disclosure has to go ahead before any trial. I think that’s around eight weeks prior. That aside, it still seems to me to be pretty clear the various named persons will either have to settle to some extent prior to any trial date or go ahead and defend the action. This isn’t as a whole being but as individuals. For example, Jenkins and Dineen will be separate defendants as will the rest of the then board. Any award will not be paid for by the club but by the individuals from their own personal wealth, if of course they lose the action. That will be measured by percentages, but I’m pretty certain won’t amount to the actual money lost by the trust when the sale went ahead. That’s my take on it, please discuss that here folks, give it some thought before pressing enter, there are clearly some differing stances on here, which is healthy and as I would expect in a society where personal interests and views will always be different. If we can keep the topic on this thread it will be an interesting discussion. | |

| The action taken by Swansea City Supporters Trust on 13:06 - Nov 25 by ReslovenSwan1 | I suspect we are not "too far down the road". The landscape has changed in the last 4 and a half years. What was valid in 2016 does not apply in 2020 even less in 2021. Inflation has occured. The two main protaginists and departed from executive positions. People have got tired of this. The fees are horrendous based on past precedent and members do not even seem to know what they voted for or what it costs. A sad state of affairs. You do not know the consequence of a Trust loss. doyou assume no cnsequences as in a no win no fee?. I suspect the Trusts case is not as strong as once imagined as the dirty linen has come into view. If the funders are uneasy they will not proceed unless they are protected from paying legal costs, insurane might be one option but that ads tothe costs I would imagine. The easiest insurnce is by using the Trust's own shares as collateral. If they propose proceeeding on this basis the members should be very concerned. I have been told if a 'no win no fee' deal has been agreed the funders must have to very very confident sure of victory. I am not sure this i the case. A 'strong case' is not enough. |
- You're right in some ways - it probably aren't too far for the defendants to settle out of court. And that would also provide some closure. - Inflation in no way dismisses the actions of the defendants though. Whether some people are in positions or not is also irrelevant. You can't have a new members vote everytime someone from the trust or the sellouts move on. The case remains identical. And if another vote was allowed, that would take yet more time and this comes against a backdrop of people such as yourself lambasting them for time wasting. - Do you know the consequences of the action? You are equally vehemently against it, without every fact yourself. - What dirty linen? And what is there to suggest the case isn't as strong as it was? - You've claimed this a few times now but do you have any evidence at all that the trusts shares could be used as collateral? - Correct, it's definitely something as a trust member that I'd like to have a discussion on. But there os zero evidence that this part of the deal. - Who's told you that? What threshold of case would you consider sufficient? If its 'watertight' very few cases would ever go to court.

For the last and final time, its not the sale that most people are concerned with, its the duplicitous manner in which it was conducted. You obviously don't agree, c'est la vie.

Sense at long last from an objective poster. Barristers are legalised thugs in gowns who will screw anyone for personal gain -their gain. Losing cases is no good to them. It's why they lie, cheat ,bully, connive and cheat in front of the big boy -fellow man of Silk. Anyone who believe a "good" case will result in a "guilty" verdict is criminally insane. It is ALL about the presentation of the case.Who does it best wins. I cannot believe the naivity I'm seeing. I cannot believe losing the case will benefit the Trust or the Club. I think the problems and nuances of the court system are well known by everyone and is part of the reason why the trust tried alternative methods to resolve the case before getting to this point. Also, those nuances and characteristics you describe should not prevent a parties pursuit of justice. But both sides are going to have legal representation, its not as if the defendants are the only ones that will. So either party will have their opportunity to 'cheat' and 'bully'.

Trust volunteers presumably could be summoned against their will as witnesses. It is not voluntry issue. The case could be quite traumatic for individuals who have only ever wanted to stay in the background and do a steady job.

Absolutely although you shouldn't be on the board of anything if you're not prepared for such things. The trust board have known all along getting called is a possibility so they'll be prepared. After all a QC has stated they have a strong case so if they give their truthful version of events there should be no issue.

With respect, they are not by all. The court process is both complicated and arcane and with good reaon;law are pased by politicians often legally trained and Judiciary practices going back centuries. The court dress itself for counsel is thickly coated by centuries of "tradition". Court is a foreign land for joe public ,apart from criminals of course, where it is normal hassle of the job

Still, this will be Civil Court and rather less intimidating. I would be staggered if Jenks and Dineed have not already had many meeting with Counsel to contest the matter and taken measures to protect their assets. To me,many people are simply dumb, stupid ,naive or consumed with hatred on this issue and the cool heads will win. Meanwhile...our club looks to get back to the Premier League. I do not concern myself with documents just principles and figures. The Shareholders Agreement. I have never seen it. Was it valid or not? I have no idea. How can I comment? It does not stop others. I am against legal action as it seems to involve giving English public school people a lot of the Trust's money maybe up to half. This money was created by the potential resondents who helped creat the Trust in the first place. They will only ever recover around £12-14m. If Cooper takes the Club to the PL the latest estimate is a valuation of £42m . I believe Swansea will get promoted within the next 5 years. 4% interest on £42m is enough to run the academy. I am the only one making this case. Most on this site never gave it any consideration, It was probably "too boring".

It is in the public domain that Leigh Dineen and Huw Jenkins both asked the Trust themselves to rip up the SHA. Jenkins solicitor then wrote to the Trust to ask them to rip up the SHA. Why do you think they did that?

So you've realised you've been caught out on the straw clutching prison so i see you've tried a new tact&ignored the responses. - you have no idea what the terms are of the trust's legal representation but you seem all too keen to comment on that. But because you know that Huws actions are indefensible you try to sweep it under the carpet. Doesnt sound very principled to me. Luckily the judge will not sweep it under the carpet. - Again these speculative, hypothetical figures do nothing to excuse the sellouts actions. The sellouts and Americans could always settle before the trial to stop this money to English public school people. - If we're going up the club will have enough money to run the academy whatever happens though won't it? You yourself have even said it was a bad idea of the Americans to downgrade it so presumably you think its affordable now even in the championship. So sorry, nice try your own logic has come back to bite you again. Another desperate straw clutching empty scenario myth busted. -

I did a quick google search of this 21% possibly being worth £42m if we returned to the Premier league, and the only link i could find on the whole WWW was contained in a thread on here started by yourself. But hey. Let's go with the crazy notion that the stars are aligned, we gain promotion to the Premier league and the club as a whole is sold for £200m with the trust receiving £42m. Why then would the trust use their 4%pa growth to run the academy, as this flies in the face of your inflation theory which was the first word you used in the title of the same thread! It is contradictions and inaccuracies such as these, why most on this site never give them consideration! [Post edited 25 Nov 2020 18:34]
