The action taken by Swansea City Supporters Trust 10:16 - Nov 21 with 18646 viewsKeithHaynes

It’s been an interesting topic for sure, which does sometimes spill over in to other threads, and understandably so. I've taken some time out to look at the specific action taken. It’s my understanding that this is very clearly down to specific issues around the weeks leading up to the sale of the club by the old board. The exclusion of the supporters trust in the sale and despite the trust wishing to be involved were excluded. That’s the basis of the action. For it to be a valid action the statements of truth gathered by the ( plaintiff) other words are used to describe them have to have some depth in law. Clearly the trust haven’t gone ahead to freeze assets and this is another topic which needs clarification. This action is not against Swansea City FC, as it was then or is now. The claims being brought are not against the club.

They are against those individuals who sold the club as they were, not the club as it was, nor as it is now. I think this should be a key area for people to dwell upon. I would have thought both sides ( and there are many sides named because it isn’t one entity) will have already disclosed at least some, but not all of their paperwork similar to criminal cases ( CPIA it’s called criminally ) As there is no fixed date as yet for a trial my understanding is full disclosure has to go ahead before any trial. I think that’s around eight weeks prior.

That aside, it still seems to me to be pretty clear the various named persons will either have to settle to some extent prior to any trial date or go ahead and defend the action. This isn’t as a whole being but as individuals. For example, Jenkins and Dineen will be separate defendants as will the rest of the then board. Any award will not be paid for by the club but by the individuals from their own personal wealth, if of course they lose the action. That will be measured by percentages, but I’m pretty certain won’t amount to the actual money lost by the trust when the sale went ahead.

That’s my take on it, please discuss that here folks, give it some thought before pressing enter, there are clearly some differing stances on here, which is healthy and as I would expect in a society where personal interests and views will always be different. If we can keep the topic on this thread it will be an interesting discussion.

A great believer in taking anything you like to wherever you want to.

Exactly. I doubt the Trust wanted these legal costs, they’ve been forced into it by those charitable and engaging sellouts.

Indeed.

It takes a strange mindset where the wronged are more criticised than than the defendants.

Not really.

Owners of a football club have personal and financial investments in it. They are always going to make self serving decisions. It’s like being mad at a manager when he leaves.

The Trust was there to be the part of the club that acted on behalf of the club and its supporters and its failed at every single turn. It showed incredible lack of foresight and forward planning.

They were just coasting and were caught sleeping. They have spent the last 5 years scrambling around about 9 steps behind, spending much of that time covering for their own huge misgivings.

I see it like going on a Safari. Who would you be mad at if you got attacked? The lion or the tour guides for not protecting you sufficiently?

"Mindset". Thankyou Chief that is great word like "holistic".

You and your soulmates are trapped in a defective and negative "mindset". The horrors of the" Petty era" cast a shadow over your footsteps. Your words are the word of fear and you demand rock solid 'guarentees'. Years of forum whinging has taken its toll . You are trapped. It will not be easy to change this. The brain like the body needs exercise. It needs stretching by challenging percieved ideas given to you by others. Without challenge the brain become stale. Changing a perception is as rare as wins at Tottenham Hotspur.

"Its no good being worth £20m if we cannot find a buyer". This is typical of this mindset. Got to court when anything can happen and have a "guarenteed forced sale". But you have to pay £8m in fees and will wreck any chance of a good working relationship. "Somebody said somewhere we did not have to pay tax." Yeah sure.

There is a bogey man around every corner. With the Trust doing 'Due dilligence' not even the celebrity cook at Norwich would get the gig. "Yankee hedgefunders are bound to be dodgey". Total nonscence.

THE TRUST HAVE NOT BEEN WRONGED. Its a fabrication and a myth. They win if they had sold in 2017, they could win even more by not selling. Standing still they will probably be all square with 2016 in 3 or 4 years If Swansea goes about its business in a sensible way its future is bright. This is because of inflation. If the club falls down the league there could be an issue but there is no imminent sign of that.

You have a victim "mindset". The only people likely to fleece the Trust are the legal case funders. They will want an arm and a leg. If they percieve the case to be risky both legs.
There is no way back once they are finished with you. They profit from conflict and a lack of cmmunication.

So how have the Trust done in economic terms?
In my own investments I am looking for 4%. Even allowing for a zero value for the shares, and the pathetic interest the Trust is getting on their cash holding the Trust are grossing 7-8% per annum with inflation around 2%.

For guidance to double its value in 10 years you need 7% per anum. 7% growth per year is doubling in 10 year and going up 4 times in 20 years.

In 2002 The Trust invested £200,000 into the club. They have recieved 7% per year on that in dividends for 20 years. They now are worth £880,000 so have quadrupled their cash investment in cash. Excellent work thanks to the dividend given in 2014 or so.

This is paled into insignificance by the value of the shares themselves. Shares valuations are up 60 times based on the Derby valuation n the championship and if the club gets to the PL it could be worth 200 times the original investment. (Burnley valuation). This is unvbelievably good either way. If Swansea get to the PL the sellers will be the losers. The smart investor hedges his bets and retains a holding just in case. You know who they are.

The Judge in Court, if he is like me. might want theses details. Where exactly have you been wronged? What are the defendants in court for? Making the Trust multimillionaires ?

- So we're just meant to accept what happened. You dont give any reasons as to why we should though. Just because it happened? Strange.
- Sweeping statement next which contradicts yourself. Because by your logic the trust and supporters should get on with it and accept what happened. By saying they were sleeping you're implying they let something happen on their watch - which is fine by you anyway. Thats just completely random mudslinging with no basis isn't it.
- how could they be prepared for something that they deliberately nof told was happening. The Americans have admitted doing this.
- You obviously haven't been paying attention to tge timeline of events then have you. And it was the likes of Huw Jenkins scurrying around doctoring meeting minutes and trying to destroy a shareholders agreement.
- that lion would get shot if it attacked humans. There's consequences for actions.

- Disagree - with that sort of 'mindset' the trust wouldn't be taking the case to court to get justice . They'd be meekly sitting back pretending it never happened like you Quislings.
- 8 mill fees is completely fabricated mind.
- You yourself have told us several times these Americans would financially rape the club if they needed money.
- you typing in capital letters does not make it true. They have been wronged - youll ignore this again but the Americans and Huw have admitted to actoons ensuring this.
- Again, a victim would meekly accept what happened.
- is any of the next bit relevant to the case at all? Hypothetical figures from other club's that haven't been sold? You yourself have admitted that "any deal with a mark up that good can never be seen as a bad deal". Your own words. Yet, you use a different standard when it comes to the trust. Strange that.
- Luckily the judge isn't as likely to hate the trust as much as you. Made them millionaires - well the Americans haven't - the opposite in fact. So if the sellouts made the trust millionaire's, why aren't the trust allowed to cash that out if they wish then? Like the sellouts did?

Are just going to keep repeating the same inane nonsense or actually address and accept what happened?

"As rare as wins at Tottenham Hotspur" when ironically they currently top the EPL.

It's not about being victims though, it's about justice. The trust have made mistakes but they were, in many peoples opinions, wronged when (as admitted by the Americans) they were kept out of the sale. The trust has made more mistakes since and now it'll be up to a court to decide just if they were (and if so) and how much they were wronged.

Myabe as the full truth (hopefully) comes out whoever is right or wrong on here will accept the decision and we move on.

My biggest reservation about any legal action is that it proves to be a distraction and damages the team.

Just my opinion, but WTF do I know anyway?

and your last paragraph is my concern ,as Ive stated only for this opinion to be ridiculed.

It is the very core of this issue.

It's been said to me that it ha nowt to do with the club per se.Really!.

It is all about the club which was the subject of the sale -the very issue that burns people's retinas.

This will be big new in south Wales especially for BBC Cardiff if the action is lost. It will do zero good for the club should the Court not decided for the Plaintiffs and it concerns me greatly, far more than seeking revenge or justice over 4 devious incompetent Jerks who made a few bob.
Time has moved on ,like it or not and this ,to me ,is a retrograde step.

I don't think anyone has ridiculed that the viewpoint stop acting the victim. It's a valid point but id counter it by saying that the trust have held off from proceedings in the past when we were in danger of relegation - now people are asking to to postpone again because we're high up in the championship early into a season. When would be the opportune moment? You'd get people moaning whenever its done. There's also the fact that there's no fans at games&there are unlikely to be for some so that rules out any 'toxic atmosphere'. I dont think the players sit in on board meetings either. And of course proceedings are not against the club so there's zero risk to the players livelihoods.

The Cardiff centric media can crow all thsy want, at least we have a supporters trust doing something about the situation. Their club bent over and wore red shirts in theirs.

To answer your last question I will use your analogy posted under the thread "the art of selling"

This 206 of which you own 21 % is sold by the remiander of your family wife and 3 kids who between own 79% but have less of an individual share holding than you the "majority" shareholder.
The other shareholders know your reluctnace to part with the car having tried to get you involved with a previous sale go behind your back and agree a sale...oh and by the way you dont get a penny from the ssle of your much loved car even though you hold the single biggest stake. How would you feel then?

AS discussed elsewhere I am fed up with this whole debate there are two sidesto every story but the way the Trust is continually portrayed as the "evil" ones is so wrong ...AS said eleswhere this debate will reage on no doubt but the amount of hyperbole that is generated by those who support the sellouts is beyond belief.

If it's not libel or slander let him post his thoughts. The days are gone when you can come on here and bully.

What bit is bullying?

I’m saying it’s not his opinion the guy is telling lies and making things up.
None of what he is saying is true.

Your thoughts on the sellouts competence while at the club or the people apparently taking shots of you are not really relevant to the thread see. Probably best you take yoyr squabbles offline and start another thread to reflect on the Huw Jenkins performance as chairman if you want

But the court case has nothing to do with 2002 whatsoever. The shareholders agreement, falsified minutes etc are going to be what the judge will be keen to learn about here. Not some waffle about dividends that all shareholders earned.

Oh I am WR.
For the Simpletons, lies are that what you dont understand, but one can use lies to become facts if repeated. These are the turds of life we have to flush away.

I have disagreed with hundreds on this and other site including Resolven ,Parnussus and I will also AGREE if I see fit. It s because I look at the text, issue and facts and then make a decision. I see accuations of "sticking up " for omeone. That expression was one we used in junior school circa 1960.

Just please folks, wind yer necks in and move on .Life is short and thhere are many we have lost who would loved to be around right now. We are wasting our time and lives on here by behaving like narrow minded ,insular jerks ;It's something like a Sicilian feud but without Pacino or De Niro in starring roles.

'moving on' isnt going to happen. Accept it. We're so far down the road now the only thing that will bring something resembling closure now is the case.

I for one (unless there's an obvious miscarriage of justice) will accept the result and move on even in a trust loss.

I suspect we are not "too far down the road".

The landscape has changed in the last 4 and a half years. What was valid in 2016 does not apply in 2020 even less in 2021. Inflation has occured. The two main protaginists and departed from executive positions. People have got tired of this. The fees are horrendous based on past precedent and members do not even seem to know what they voted for or what it costs. A sad state of affairs.

You do not know the consequence of a Trust loss. doyou assume no cnsequences as in a no win no fee?.
I suspect the Trusts case is not as strong as once imagined as the dirty linen has come into view. If the funders are uneasy they will not proceed unless they are protected from paying legal costs, insurane might be one option but that ads tothe costs I would imagine. The easiest insurnce is by using the Trust's own shares as collateral. If they propose proceeeding on this basis the members should be very concerned.

I have been told if a 'no win no fee' deal has been agreed the funders must have to very very confident sure of victory. I am not sure this i the case. A 'strong case' is not enough.
